Radical Amnesty Bill Introduced in House
On Tuesday, December 15, open borders advocate Luis Gutierrez (D-IL) introduced H.R. 4321, the “Comprehensive Immigration Reform for America’s Security and Prosperity Act of 2009,” (CIR ASAP). H.R. 4321 would grant amnesty to millions of illegal aliens, dramatically increase legal immigration, and create loopholes in existing penalties in exchange for promises of “enforcement” in the future. (See FAIR’s Legislative Updates from October 19, 2009 and December 14, 2009). At introduction, CIR ASAP had over 90 original co-sponsors in the House of Representatives. (See Cosponsor listing).
CIR ASAP contains several amnesty programs, including AgJOBS (Title IV, Subtitle B); the DREAM Act (sprinkled throughout the bill); and a broad amnesty program through which millions of illegal aliens could obtain “earned legalization” (Title IV, Subtitle A). These provisions are in many ways similar to those in the Bush-Kennedy Amnesty Bill of 2007, except that several significant requirements have been weakened. For example, for an illegal alien to receive amnesty under H.R.4321, he or she does not even have to establish employment, only that he or she is an active member of the community.
In addition to granting amnesty, CIR ASAP would dramatically increase legal immigration by:
• Recapturing purportedly “unused” family and employment-based green cards from 1992 to 2008 (§301(a)-(b)). According to State Department data, this provision alone could bring in as many as 550,000 immigrants—all of whom would compete with American workers for jobs. (U.S. State Department, Unused Family and Employment Preferences Numbers Available for Recapture, Fiscal Years 1992-2007).
• Expanding the definition of “immediate relatives” to include children and spouses of lawful permanent residents. (§302). This would allow an unlimited number of these children and spouses to immediately qualify for a visa.
• Increasing the annual per country limits on family and employment-based visas from seven percent to ten percent. (§303). Under current law, each foreign country has a seven percent share of the total cap of visas allocated each year.
In exchange for the multiple amnesties and massive increases in legal immigration proposed in the bill, H.R. 4321 contains measures ostensibly aimed at strengthening immigration “enforcement.” Upon closer examination, however, CIR ASAP would actually undermine the enforcement of our immigration laws. For example, the bill would:
• Repeal the highly successful 287(g) program, which allows federal officials to train state and local law enforcement agencies in the enforcement of federal immigration laws. (§184).
• Establish a new, untested electronic employee verification system. (§201). This would completely reverse years of progress made with respect to E-Verify.
• Temporarily suspend Operation Streamline pending a re-evaluation of the program’s future viability. (§125(a)). Operation Streamline is a highly successful, zero-tolerance program that targets illegal aliens for immediate prosecution upon apprehension at or near the border. After Operation Streamline was put into effect in December 2006, the Yuma, Arizona sector saw nearly 1200 prosecutions in the first 9 months. Border apprehensions decreased by 70 percent. (CBP Press Release, July 24, 2007).
• Prohibit the Armed Forces and the National Guard from assisting in securing the border unless: (1) the President declares a national emergency, or (2) the use of the Armed Forces/National Guard is required for specific counter-terrorism duties. (§131(a) & (b)).
• Require the Department of Homeland Security (DHS) to identify and inventory the current personnel, human resources, assets, equipment, supplies, or other physical resources dedicated to border security and enforcement prior to any increase in these categories. (§114(a); §116(a)).
At a press conference announcing the introduction of his bill, Rep. Gutierrez indicated that his bill was to set the Congressional Hispanic Caucus’s standard for immigration reform legislation. However, he also acknowledged that the Senate will most likely be the first chamber to act on amnesty legislation. While a bill has not yet been introduced in the Senate, Senator Chuck Schumer (D-NY) is planning to introduce a bill in early 2010, and Senate Majority Leader Harry Reid (D-NV) has indicated he will kick off the amnesty debate sometime in February or March. Another victory for American workers in Arizona. Yesterday, the Ninth Circuit Court of Appeals upheld the get-tough employer sanctions law in the state. The law hits employers who knowingly hire illegal aliens with strict penalties and in some cases even strips businesses of their licenses. A lower court upheld the same law in February. But open-borders and amnesty groups along with the business lobby are considering yet another appeal.

In California, League of United Latin American Citizens has adopted a resolution to declare "California Del Norte" a sanctuary zone for immigrants. Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Some of the most violent criminals at large today are illegal aliens. Yet in cities where the crime these aliens commit is highest, the police cannot use the most obvious tool to apprehend them: their immigration status. In Los Angeles, for example, dozens of members of a ruthless Salvadoran prison gang have sneaked back into town after having been deported for such crimes as murder, assault with a deadly weapon, and drug trafficking. Police officers know who they are and know that their mere presence in the country is a felony. Yet should a cop arrest an illegal gangbanger for felonious reentry, it is he who will be treated as a criminal, for violating the LAPD’s rule against enforcing immigration law.

The LAPD’s ban on immigration enforcement mirrors bans in immigrant-saturated cities around the country, from New York and Chicago to San Diego, Austin, and Houston. These “sanctuary
policies” generally prohibit city employees, including the cops, from reporting immigration violations to federal authorities.

Such laws testify to the sheer political power of immigrant lobbies, a power so irresistible that police officials shrink from even mentioning the illegal-alien crime wave. “We can’t even talk
about it,” says a frustrated LAPD captain. “People are afraid of a backlash from Hispanics.” Another LAPD commander in a predominantly Hispanic, gang-infested district sighs: “I would get a firestorm of criticism if I talked about [enforcing the immigration law against illegals].” Neither captain would speak for attribution.

But however pernicious in themselves, sanctuary rules are a symptom of a much broader disease: the nation’s near-total loss of control over immigration policy. Fifty years ago, immigration policy might have driven immigration numbers, but today the numbers drive policy. The nonstop increase of immigration is reshaping the language and the law to dissolve any distinction between legal and illegal aliens and, ultimately, the very idea of national borders.

It is a measure of how topsy-turvy the immigration environment has become that to ask police officials about the illegal-alien crime problem feels like a gross faux pas, not done in polite company. And a police official asked to violate this powerful taboo will give a strangled response—or, as in the case of a New York deputy commissioner, break off communication altogether. Meanwhile, millions of illegal aliens work, shop, travel, and commit crimes in plain view, utterly secure in their de facto immunity from the immigration law.


Police commanders may not want to discuss, much less respond to, the illegal-alien crisis, but its magnitude for law enforcement is startling. Some examples:

• In Los Angeles, 95 percent of all outstanding warrants for homicide (which total 1,200 to 1,500) target illegal aliens. Up to two-thirds of all fugitive felony warrants (17,000) are for illegal aliens.

• A confidential California Department of Justice study reported in 1995 that 60 percent of the 20,000-strong 18th Street Gang in southern California is illegal; police officers say the proportion is actually much greater. The bloody gang collaborates with the Mexican Mafia,
the dominant force in California prisons, on complex drug-distribution schemes, extortion, and drive-by assassinations, and commits an assault or robbery every day in L.A. County. The gang
has grown dramatically over the last two decades by recruiting recently arrived youngsters, most of them illegal, from Central America and Mexico.

• The leadership of the Columbia Lil’ Cycos gang, which uses murder and racketeering to control the drug market around L.A.’s MacArthur Park, was about 60 percent illegal in 2002, says former assistant U.S. attorney Luis Li. Francisco Martinez, a Mexican Mafia member and an illegal alien, controlled the gang from prison, while serving time for felonious reentry following deportation.

Good luck finding any reference to such facts in official crime analysis. The LAPD and the L.A. city attorney recently requested an injunction against drug trafficking in Hollywood, targeting the 18th Street Gang and the “non–gang members” who sell drugs in Hollywood for the gang. Those non–gang members are virtually all illegal Mexicans, smuggled into the country by a ring organized by 18th Street bigs. The Mexicans pay off their transportation debts to the gang by selling drugs; many soon realize how lucrative that line of work is and stay in the business.

Cops and prosecutors universally know the immigration status of these non-gang “Hollywood dealers,” as the city attorney calls them, but the gang injunction is assiduously silent on the matter. And if a Hollywood officer were to arrest an illegal dealer (known on the street as a “border brother”) for his immigration status, or even notify the Immigration and Naturalization Service (since early 2003, absorbed into the new Department of Homeland Security), he would face severe discipline for violating Special Order 40, the city’s sanctuary policy.

L.A.’s sanctuary law and all others like it contradict a key 1990s policing discovery: the Great Chain of Being in criminal behavior. Pick up a law-violator for a “minor” crime, and you might well prevent a major crime: enforcing graffiti and turnstile-jumping laws nabs you murderers and robbers. Enforcing known immigration violations, such as reentry following deportation, against known felons, would be even more productive. LAPD officers recognize illegal deported gang members all the time—flashing gang signs at court hearings for rival gangbangers, hanging out on the corner, or casing a target. These illegal returnees are, simply by being in the country after deportation, committing a felony (in contrast to garden-variety illegals on their first trip to the U.S., say, who are only committing a misdemeanor). “But if I see a deportee from the Mara Salvatrucha [Salvadoran prison] gang crossing the street, I know I can’t touch him,” laments a Los Angeles gang officer. Only if the deported felon has given the officer some other reason to stop him, such as an observed narcotics sale, can the cop accost him—but not for the immigration felony.

The stated reasons for sanctuary policies are that they encourage illegal-alien crime victims and witnesses to cooperate with cops without fear of deportation, and that they encourage illegals to take advantage of city services like health care and education (to whose maintenance few illegals have contributed a single tax dollar, of course). There has never been any empirical verification that sanctuary laws actually accomplish these goals—and no one has ever suggested not enforcing drug laws, say, for fear of intimidating drug-using crime victims. But in any case, this official rationale could be honored by limiting police use of immigration laws to some subset of immigration violators: deported felons, say, or repeat criminal offenders whose immigration status police already know.

The real reason cities prohibit their cops and other employees from immigration reporting and enforcement is, like nearly everything else in immigration policy, the numbers. The immigrant population has grown so large that public officials are terrified of alienating it, even at the expense of ignoring the law and tolerating violence. In 1996, a breathtaking Los Angeles Times exposé on the 18th Street Gang, which included descriptions of innocent bystanders being murdered by laughing cholos (gang members), revealed the rate of illegal-alien membership in the gang. In response to the public outcry, the Los Angeles City Council ordered the police to reexamine Special Order 40. You would have thought it had suggested reconsidering Roe v. Wade. A police commander warned the council: “This is going to open a significant, heated debate.” City Councilwoman Laura Chick put on a brave front: “We mustn’t be afraid,” she declared firmly.

But of course immigrant pandering trumped public safety. Law-abiding residents of gang-infested neighborhoods may live in terror of the tattooed gangbangers dealing drugs, spraying graffiti, and shooting up rivals outside their homes, but such anxiety can never equal a
politician’s fear of offending Hispanics. At the start of the reexamination process, LAPD deputy chief John White had argued that allowing the department to work closely with the INS would give cops another tool for getting gang members off the streets. Trying to build a homicide case, say, against an illegal gang member is often futile, he explained, since witnesses fear deadly retaliation if they cooperate with the police. Enforcing an immigration violation would allow the cops to lock up the murderer right now, without putting a witness’s life at risk.

But six months later, Deputy Chief White had changed his tune: “Any broadening of the policy gets us into the immigration business,” he asserted. “It’s a federal law-enforcement issue, not a local law-enforcement issue.” Interim police chief Bayan Lewis told the L.A. Police ommission: “It is not the time. It is not the day to look at Special Order 40.”

Nor will it ever be, as long as immigration numbers continue to grow. After their brief moment of truth in 1996, Los Angeles politicians have only grown more adamant in defense of Special Order 40. After learning that cops in the scandal-plagued Rampart Division had cooperated with the INS to try to uproot murderous gang members from the community, local politicians threw a fit, criticizing district commanders for even allowing INS agents into their station houses. In
turn, the LAPD strictly disciplined the offending officers. By now, big-city police chiefs are unfortunately just as determined to defend sanctuary policies as the politicians who appoint them; not so the rank and file, however, who see daily the benefit that an immigration tool would bring. But even were immigrant-saturated cities to discard their sanctuary policies and start enforcing immigration violations where public safety demands it, the resource-starved immigration authorities couldn’t handle the overwhelming additional workload.

The chronic shortage of manpower to oversee, and detention space to house, aliens as they await their deportation hearings (or, following an order of removal from a federal judge, their actual deportation) has forced immigration officials to practice a constant triage. Long ago, the feds stopped trying to find and deport aliens who had “merely” entered the country illegally through stealth or fraudulent documents. Currently, the only types of illegal aliens who run any risk of catching federal attention are those who have been convicted of an “aggravated felony” (a particularly egregious crime) or who have been deported following conviction for an
aggravated felony and who have reentered (an offense punishable with 20 years in jail).

But even when immigration officials actually arrest someone, and even if a judge issues a final deportation order (usually after years of litigation and appeals), they rarely have the manpower to put the alien on a bus or plane and take him across the border. Second alternative: detain him pending removal. Again, inadequate space and staff. In the early 1990s, for example, 15 INS officers were in charge of the deportation of approximately 85,000 aliens (not all of them criminals) in New York City. The agency’s actual response to final orders of removal was what is known as a “run letter”—a notice asking the deportable alien kindly to show up in a month or
two to be deported, when the agency might be able to process him. Results: in 2001, 87 percent of deportable aliens who received run letters disappeared, a number that was even higher—94 percent—if they were from terror-sponsoring countries.

To other law-enforcement agencies, the feds’ triage often looks like complete indifference to immigration violations. Testifying to Congress about the Queens rape by illegal Mexicans, New York’s criminal justice coordinator defended the city’s failure to notify the INS after the rapists’ previous arrests on the ground that the agency wouldn’t have responded anyway. “We have time and time again been unable to reach INS on the phone,” John Feinblatt said last February. “When we reach them on the phone, they require that we write a letter. When we write a letter, they quire that it be by a superior.”

Criminal aliens also interpret the triage as indifference. John Mullaly a former NYPD homicide detective, estimates that 70 percent of the drug dealers and other criminals in Manhattan’s Washington Heights were illegal. Were Mullaly to threaten an illegal-alien thug in custody that his next stop would be El Salvador unless he cooperated, the criminal would just laugh, knowing that the INS would never show up. The message could not be clearer: this is a culture that can’t enforce its most basic law of entry. If policing’s broken-windows theory is correct, the failure to enforce one set of rules breeds overall contempt for the law.

The sheer number of criminal aliens overwhelmed an innovative program that would allow immigration officials to complete deportation hearings while a criminal was still in state or federal prison, so that upon his release he could be immediately ejected without taking
up precious INS detention space. But the process, begun in 1988, immediately bogged down due to the numbers—in 2000, for example, nearly 30 percent of federal prisoners were foreign-born. The agency couldn’t find enough pro bono attorneys to represent such an army of criminal aliens (who have extensive due-process rights in contesting deportation) and so would have to request delay after delay. Or enough immigration judges would not be available. In 1997, the INS simply had no record of a whopping 36 percent of foreign-born inmates who had been released from federal and four state prisons without any review of their deportability. They included 1,198
aggravated felons, 80 of whom were soon re-arrested for new crimes.

Resource starvation is not the only reason for federal inaction. The INS was a creature of immigration politics, and INS district directors came under great pressure from local politicians to divert scarce resources into distribution of such “benefits” as permanent residency, citizenship, and work permits, and away from criminal or other investigations. In the late 1980s, for example, the INS refused to join an FBI task force against Haitian drug trafficking in Miami, fearing criticism for “Haitian-bashing.” In 1997, after Hispanic activists protested a much-publicized raid that netted nearly two dozen illegals, the Border Patrol said that it would no longer join Simi Valley, California, probation officers on home searches of illegal-alien-dominated gangs.

The disastrous Citizenship USA project of 1996 was a luminous case of politics driving the INS to sacrifice enforcement to “benefits.” When, in the early 1990s, the prospect of welfare reform drove immigrants to apply for citizenship in record numbers to preserve their welfare eligibility, the Clinton administration, seeing a political bonanza in hundreds of thousands of new welfare-dependent citizens, ordered the naturalization process radically expedited. Thanks to relentless administration pressure, processing errors in 1996 were 99 percent in New York and 90 percent in Los Angeles, and tens of thousands of aliens with criminal records, including for murder and armed robbery, were naturalized.

Another powerful political force, the immigration bar association, has won from Congress an elaborate set of due-process rights for criminal aliens that can keep them in the country indefinitely. Federal probation officers in Brooklyn are supervising two illegals—a Jordanian and an Egyptian with Saudi citizenship—who look “ready to blow up the Statue of Liberty,” according to a probation official, but the officers can’t get rid of them. The Jordanian had been caught fencing stolen Social Security and tax-refund checks; now he sells phone cards, which he uses himself to make untraceable calls. The Saudi’s offense: using a fraudulent Social Security number to get employment—a puzzlingly unnecessary scam, since he receives large sums from the Middle East, including from millionaire relatives. But intelligence links him to terrorism,
so presumably he worked in order not to draw attention to himself. Currently, he changes his cell phone every month. Ordinarily such a minor offense would not be prosecuted, but the government, fearing that he had terrorist intentions, used whatever it had to put him in prison.

Now, probation officers desperately want to see the duo out of the country, but the two ex-cons have hired lawyers, who are relentlessly fighting their deportation. “Due process allows you to stay for years without an adjudication,” says a probation officer in frustration. “A regular immigration attorney can keep you in the country for three years, a high-priced one for ten.” In the meantime, Brooklyn probation officials are watching the bridges.

Even where immigration officials successfully nab and deport criminal aliens, the reality, says a former federal gang prosecutor, is that “they all come back. They can’t make it in Mexico.” The tens of thousands of illegal farm workers and dishwashers who overpower U.S. border controls every year carry in their wake thousands of brutal assailants and terrorists who use the same smuggling industry and who benefit from the same irresistible odds: there are so many more of
them than the Border Patrol.

For, of course, the government’s inability to keep out criminal aliens is part and parcel of its inability to patrol the border, period. For decades, the INS had as much effect on the migration of
millions of illegals as a can tied to the tail of a tiger. And the immigrants themselves, despite the press cliché of hapless aliens living fearfully in the shadows, seemed to regard immigration
authorities with all the concern of an elephant for a flea.

Certainly fear of immigration officers is not in evidence among the hundreds of illegal day laborers who hang out on Roosevelt Avenue in Queens, New York, in front of money wire services, travel agencies, immigration-attorney offices, and phone arcades, all catering to the
local Hispanic population (as well as to drug dealers and terrorists). “There is no chance of getting caught,” cheerfully explains Rafael, an Ecuadoran. Like the dozen Ecuadorans and Mexicans on his particular corner, Rafael is hoping that an SUV seeking carpenters for $100 a day will show up soon. “We don’t worry, because we’re not doing anything wrong. I know it’s illegal; I need the papers, but here, nobody asks you for papers.”

Even the newly fortified Mexican border, the one spot where the government really tries to prevent illegal immigration, looms as only a minor inconvenience to the day laborers. The odds, they realize, are overwhelmingly in their favor. Miguel, a reserved young carpenter, crossed the border at Tijuana three years ago with 15 others. Border Patrol spotted them, but with six officers to 16 illegals, only five got caught. In illegal border crossings, you get what you pay for, Miguel says. If you try to shave on the fee, the coyotes will abandon you at the first problem. Miguel’s wife was flying into New York from Los Angeles that very day; it had cost him $2,200 to get her
across the border. “Because I pay, I don’t worry,” he says complacently.

The only way to dampen illegal immigration and its attendant train of criminals and terrorists—short of an economic revolution in the sending countries or an impregnably militarized border—is to remove the jobs magnet. As long as migrants know they can easily get work, they will find ways to evade border controls. But enforcing laws against illegal labor is among government’s lowest priorities. In 2001, only 124 agents nationwide were trying to find and prosecute the hundreds of thousands of employers and millions of illegal aliens who violate the employment laws, the Associated Press reports.

Even were immigration officials to devote adequate resources to worksite investigations, not much would change, because their legal weapons are so weak. That’s no accident: though it is a crime to hire illegal aliens, a coalition of libertarians, business lobbies, and left-wing advocates has consistently blocked the fraud-proof form of work authorization necessary to enforce that ban. Libertarians have erupted in hysteria at such proposals as a toll-free number to the Social Security Administration for employers to confirm Social Security numbers. Hispanics warn just as stridently that helping employers verify work eligibility would result in discrimination
against Hispanics—implicitly conceding that vast numbers of Hispanics work illegally.

The result: hiring practices in illegal-immigrant-saturated industries are a charade. Millions of illegal workers pretend to present valid documents, and thousands of employers pretend to
believe them. The law doesn’t require the employer to verify that a worker is actually qualified to work, and as long as the proffered documents are not patently phony—scrawled with red crayon on a matchbook, say—the employer will nearly always be exempt from liability merely by having eyeballed them. To find an employer guilty of violating the ban on hiring illegal aliens, immigration authorities must prove that he knew he was getting fake papers—an almost
insurmountable burden. Meanwhile, the market for counterfeit documents has exploded: in one month alone in 1998, immigration authorities seized nearly 2 million of them in Los Angeles, destined for immigrant workers, welfare seekers, criminals, and terrorists.

For illegal workers and employers, there is no downside to the employment charade. If immigration officials ever do try to conduct an industry-wide investigation—which will at least net the illegal employees, if not the employers—local congressmen will almost certainly head it off. An INS inquiry into the Vidalia-onion industry in Georgia was not only aborted by Georgia’s congressional delegation; it actually resulted in a local amnesty for the growers’ illegal workforce. The downside to complying with the spirit of the employment law, on the other hand, is considerable. Ethnic advocacy groups are ready to picket employers who dismiss illegal workers, and employers understandably fear being undercut by less scrupulous competitors.

Of the incalculable changes in American politics, demographics, and culture that the continuing surge of migrants is causing, one of the most profound is the breakdown of the distinction between legal and illegal entry. Everywhere, illegal aliens receive free public education and free medical care at taxpayer expense; 13 states offer them driver’s licenses. States everywhere have been pushed to grant illegal aliens college scholarships and reduced in-state tuition. One hundred banks, over 800 law-enforcement agencies, and dozens of cities accept an identification card created by Mexico to credentialize illegal Mexican aliens in the U.S. The Bush administration has given its blessing to this matricula consular card, over the strong protest of the FBI, which warns that the gaping security loopholes that the card creates make it boon to money launderers, immigrant smugglers, and terrorists. Border authorities have already caught an Iranian man sneaking across the border this year, Mexican matricula card in hand.

Illegal aliens and their advocates speak loudly about what they think the U.S. owes them, not vice versa. “I believe they have a right . . . to work, to drive their kids to school,” said California
assemblywoman Sarah Reyes. An immigration agent says that people he stops “get in your face about their rights, because our failure to enforce the law emboldens them.” Taking this idea to its extreme, Joaquín Avila, a UCLA Chicano studies professor and law lecturer, argues that to deny non-citizens the vote, especially in the many California cities where they constitute the majority, is a form of apartheid.

Yet no poll has ever shown that Americans want more open borders. Quite the reverse. By a huge majority—at least 60 percent—they want to rein in immigration, and they endorse an observation that Senator Alan Simpson made 20 years ago: Americans “are fed up with
efforts to make them feel that [they] do not have that fundamental right of any people—to decide who will join them and help form the future country in which they and their posterity will live.” But if the elites’ and the advocates’ idea of giving voting rights to non-citizen majorities catches on—and don’t be surprised if it does—Americans could be faced with the ultimate absurdity of people outside the social compact making rules for those inside it.

But the non-enforcement of immigration laws in general has an even more destructive effect. In many immigrant communities, assimilation into gangs seems to be outstripping assimilation into civic culture. Toddlers are learning to flash gang signals and hate the police, reports the Los Angeles Times. In New York City, “every high school has its Mexican gang,” and most 12- to 14-year-olds have already joined, claims Ernesto Vega, an illegal 11-year-old Mexican. Such
pathologies only worsen when the first lesson that immigrants learn about U.S. law is that Americans don’t bother to enforce it. “Institutionalizing illegal immigration creates a mindset in people that anything goes in the U.S.,” observes Patrick Ortega, the news and public-affairs director of Radio Nueva Vida in southern California. “It creates a new subculture, with a sequela of social ills.” It is broken windows writ large.

For the sake of immigrants and native-born Americans alike, it’s time to decide what our immigration policy is—and enforce it.

Three members of the same family and two others are facing charges after authorities say they seized more than $1 million worth of cocaine in Richmond.

Richmond Police Sgt. Bisa French announced Tuesday that after a yearlong investigation, federal agents and local police arrested Francisco Cruz and his brothers, Jose Cruz and Casimiro Cruz, on suspicion of drug trafficking charges last week.

Besides the three Richmond brothers, authorities also arrested Jaun Alcazar of Oakland and Edwin Garcia of Los Angeles

During the arrests, French says agents and officers seized more than 20 pounds of cocaine hidden in a car parked in a Richmond neighborhood.

French says all five suspects are being held on a no-bail warrant.

It was not known if the suspects had retained attorneys.

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Revenge in Drug War Chills Mexico

MEXICO CITY — It had been an elaborate farewell to one of Mexico’s fallen heroes.
Ensign Melquisedet Angulo Córdova, a special forces sailor killed last week during the government’s most successful raid on a top drug lord in years, received a stirring public tribute in which the secretary of the navy presented his mother with the flag that covered her son’s coffin.
Then, only hours after the grieving family had finished burying him in his hometown the next day, gunmen burst into the family’s house and sprayed the rooms with gunfire, killing his mother and three other relatives, officials said Tuesday.
It was a chilling epilogue to the navy-led operation that killed the drug lord, Arturo Beltrán Leyva, and six of his gunmen. And it appeared to be intended as a clear warning to the military forces on the front line of President Felipe Calderón’s war against Mexico’s drug cartels: not only you, but your family is a target as well.
Prosecutors, police chiefs and thousands of others have been killed in the violence gripping Mexico, with whole families sometimes coming under attack during a cartel’s assassination attempt. But going after the family of a sailor who had already been killed is an exceedingly rare form of intimidation, analysts say, and illustrates how little progress the government has made toward one of its most important goals: reclaiming a sense of peace and order for Mexicans caught in the cross-fire.
“There will be more reprisals, both symbolic ones and strategic ones,” said Guillermo Zepeda, a security expert with the Center of Research for Development, in Mexico City. “They will take revenge against not only the top people, but anybody who participates.”
The military and police forces who have been fighting the drug war typically cover their faces with ski masks to protect their identities. But the government generally releases the names of police officers and soldiers who have been killed in the drug war.
Responding to the killings on Tuesday, Mr. Calderón said, “These contemptible events are proof of how unscrupulously organized crime operates, attacking innocent lives, and they can only strengthen us in our determination to banish this singular cancer.”
The gunmen killed Ensign Angulo’s mother, Irma Córdova Palma, and his sister Yolidabey, 22, just after midnight on Tuesday as they slept, said Tabasco State officials. An aunt, Josefa Angulo Flores, 46, died on her way to the hospital and Ensign Angulo’s brother Benito died shortly after he was admitted to the hospital. Another sister, who was not identified, was injured.
Ensign Angulo, 30, was killed Dec. 16 when military forces surrounded an upscale apartment complex in the city of Cuernavaca, an hour’s drive south of Mexico City, and cornered Mr. Beltrán Leyva, who American and Mexican officials say was one of Mexico’s most violent drug lords.
Although Mr. Calderón called the death of Mr. Beltrán Leyva a significant victory in the drug war, federal officials warned almost immediately that it could spawn more violence.
Attorney General Arturo Chávez Chávez told reporters the morning after the raid against Mr. Beltrán Leyva that his subordinates would battle among one another to take his place at the head of the cartel that bears his name.
But what officials did not expect was that among the first victims would be the innocent.
Throughout the three-year-old drug war, Mexican officials have argued that only a tiny percentage of the dead are noncombatants. Indeed, the vast majority of the dead are believed to be members of drug gangs settling scores. Half of the bodies are not even claimed by their families, government officials have said.
But the government has also proved to be powerless to protect many of its own forces in the drug war, much less innocent bystanders. In just one case in July, gunmen suspected of being cartel members killed 12 federal police officers in the western state of Michoacán in retaliation for the arrest of one of their leaders.
The killings on Tuesday underscore how vulnerable civilians are. Many local police forces are corrupted by drug money, officials say, and even when they are not, they are no match for the drug gangs’ firepower.
In one of the most frightening attacks directed at civilians, suspected cartel members threw grenades into a crowd celebrating Independence Day in the president’s hometown in 2008, killing eight people. It seemed to crystallize the fear that the cartels could strike wherever and whenever they wanted, despite the deployment of thousands of troops against them.
Analysts said that new levels of narcoterrorism were possible as the drug gangs tried to spread fear among those fighting them.
“Any objective could be vulnerable,” Mr. Zepeda, the security expert, said. “The state should be expecting it.”

Kenn d’Oudney, another great writer and patriot said, quote. “The undermining of the ideals, the degeneration of the decent way of life, and the fragmentation of the former general cohesion of Western society, are a long-planned and progressively executed mission, controlled by those few who have, and wield, the power behind-the-scenes to achieve their objective. They supervise corruptible politicians (of all political complexions) and the judiciary to implement their agenda. To stop their malfeasance, their objective requires to be exposed. They must be brought to justice, for their crimes are legion and the evidence to the wrongdoing, incontrovertible.” unquote.

Few can express themselves as effectively as Mark Lowry and Kenn d’Oudney, but the feelings of knowledgeable people toward the traitors are universal and identical, mostly expressed in four letter words of contempt and anger.

Are Americans just lazy cowards who will sit on their posteriors while the criminals reduce them to living and dying homeless, hungry and in pain as slaves? Are we really so stupid and blind that we will tolerate this treatment. I think not.

Are we going to allow these traitors to continue using their privately owned, so called Federal Reserve Bank to steal everything we have as a nation and as individuals, by first inflating the economy, stealing everything they could, bailing themselves out with our money, then deflating the economy and stealing our remaining depreciated assets. This is a repeat of what they did in the great depression. For your information they have initiated the first step by taking money out of circulation.

Hell, I can guarantee you what is going to happen, when the pain is more generalized and unbearable, the people will rise up in revolt resulting in much death and destruction. Don’t you understand that this means the end of everything? This is what we are trying to prevent by defeating the traitors with the rule of law before this happens.

We must have the Rule of Law enforced at all levels and branches of government with no exceptions and most especially in the so called justice system where judges routinely make decisions based on their feelings rather than the constitution and laws. Judges also deprive jurors of required information and their constitutional powers to the detriment of defendants. The rule of law must be vigorously enforced in accordance with the constitution, without bribes, or favors.

It is imperative that members of the armed forces and law enforcement adhere to the Constitution and Laws of the United States by refusing to obey Unlawful and Unconstitutional orders from traitors who obtained power by Deceit and Fraud to satisfy their Avarice. If the military and police violate the Constitutional rights of the people by obeying unlawful orders from traitors they will be no different than the Gestapo and SS criminals who were judged at Nurnberg and hung for their crimes. In the process unlawful actions would cause a revolution.

As a Christian, I respect the Church, but I have nothing but contempt for the Cardinals, Bishops and Ministers who misuse the word of God to justify their self serving criminal actions to protect illegals at the expense of our citizens. If I was to give these clerics credit for knowing the facts, then their actions would be truly heinous, rather than just self serving and criminal.

Officials who do not enforce all the laws are corrupt enemies of the people because then we have tyranny. We can only survive without revolution if we lawfully take back our government and then proceed to impeach and prosecute government officials at all levels and branches of government.
We must use experienced combat troops to remove the criminal illegals from sanctuary cities and wherever they are located, using deadly force as required in any war. It is a war directed by the usurpers in our government. Officials in government and corporations who protect these criminal illegals should be arrested and tried by military tribunal with their resources used to compensate citizens who were victims of their treason. This is the only way to protect our people and our Republic.

We have a corrupt media controlled by traitors that would be the envy of Adolph Hitler. Most Americans don’t know that their government was hijacked by the power elite, tax free foundations and corporations because these traitors own the mainstream media that absolutely and positively refuses to report any truth not supportive of their treason.

It is the responsibility of every American who knows the truth to visit their politicians, educate them and obtain a firm written pledge from them to serve the people rather than the corporations and corrupt leaders of either political party. Anyone who knows the truth and fails to act is a Slacker and guilty of a most grievous sin for which they will suffer on this earth, and answer for later, with god and our patriots.

You do not have to be a Christian to know that the Hedonists among us ignored God’s word by killing 40 to 50 million babies by abortion, who would otherwise have supported them in their old age. Corporations replaced these murdered children with uneducated illegals and their children who will always be a financial drain on our country and negatively impact Social Security and all benefits.

Experts interviewed on the Lou Dobbs show (8-21-08) stated that our population would increase by 50% in the next forty years due mostly to legal and illegal immigration. No other country is facing such a dramatic reduction in standard of living because of population growth. This growth would require a 50% increase in required oil, food, housing and other resources. They also reported that potable water would be in short supply worldwide. Now let me put this in perspective for you poor clueless victims of the mainstream media. Oil, food and most things are scarce resources and 50% more resources are going to be required to support 50% more people. Most illegals will not speak our language, dislike us, are uneducated including a high percentage of criminals, and will never support themselves. I don’t hate these people, but all immigration must stop and the illegals must be deported quickly using whatever force is required, otherwise you will be living as a slave in a country like Mexico. Every bit of this was caused by traitors in government taking orders from large corporations for money. Make no mistake about it; anyone who now supports legal or illegal immigration is an enemy of the people.

Ending both legal and illegal immigration with swift and forceful comprehensive deportation of illegals must be accomplished because it is essential for our survival. If we should fail to take back our government with the rule of law before Americans suffer and revolt, the illegals must run for their lives. Again I am sorry if you can’t accept the brutal truth. I am predicting, not advocating.

Either educate your politicians now with rule of law while you can still save something, or suffer through a bloody civil war and end up in poverty anyway.

Did you know that when the politicians made it unlawful for us to use all of our energy resources that they were deliberately reducing our standard of living ,because cheap energy is the key to our prosperity, and that is not their objective.?

For if their efforts are perceived to be effective they will be trashed, attacked, or taken out. If God allows our work to resonate with the people resulting in defeat of the traitors, I could accept retribution by the traitors. If there is reprisal by the traitors, there will be retaliation by the people. Millions of people are actively engaged in this fight. But, to be most effective, our efforts must be focused on informing, motivating, directing and giving tools to the people so they can take action. Somehow, everyone’s work must be seen as part of the big picture to be understood by the people. The War on our people and country is ruthless, broad based, all encompassing and quite complex. People must learn how they are being screwed in so many ways by criminals in government and corporations. There is no part of our society, government, or people, et al that has not been affected adversely. It is therefore imperative that everyone focus on presenting their parts of the fight as part of the whole treason to be understood.

Roughly translated: In the next few years, according to the 59-page report titled "Building a North American Community," the U.S. must be integrated with the socialism, corruption, poverty and population of Mexico and Canada. "Common perimeter" means wide-open U.S. borders between the U.S., Mexico and Canada. As Phyllis Schlafly reveals in this issue of Whistleblower: "This CFR document asserts that President Bush, Mexican President Vicente Fox and Canadian Prime Minister Paul Martin 'committed their governments' to this goal when they met at Bush's ranch and at Waco, Texas, on March 23, 2005. The three adopted the 'Security and Prosperity Partnership of North America' and assigned 'working groups' to fill in the details. It was at this same meeting, grandly called the North American Summit, that President Bush pinned the epithet 'vigilantes' on the volunteers guarding our border in Arizona."

The CFR report – important excerpts of which are published in Whistleblower – also suggests North American elitists begin getting together regularly, and presumably secretly, "to buttress North American relationships, along the lines of the Bilderberg or Wehrkunde conferences, organized to support transatlantic relations." The Bilderberg and Wehrkunde conferences are highly secret conclaves of the powerful. For decades, there have been suspicions that such meetings were used for plotting the course of world events and especially the centralization of global decision-making.

CALIFORNIA - MEXICO'S ANSWER TO A WELFARE SYSTEM FOR POOR MEXICANS

In hosting America’s largest population of illegal immigrants, California bears a huge cost to provide basic human services for this fast growing, low-income segment of its population. A new study from the Federation for American Immigration Reform (FAIR) examines the costs of education, health care and incarceration of illegal aliens, and concludes that the costs to Californians is $10.5 billion per year.

Among the key finding of the report are that the state’s already struggling K-12 education system spends approximately $7.7 billion a year to school
the children of illegal aliens who now constitute 15 percent of the student body. Another $1.4 billion of the taxpayers’ money goes toward providing
health care to illegal aliens and their families, the same amount that is spent incarcerating illegal aliens criminals.

“California’s addiction to ‘cheap’ illegal alien labor is bankrupting the state and posing enormous burdens on the state’s shrinking middle class tax base,”
stated Dan Stein, President of FAIR. “Most Californians, who have seen their taxes increase while public services deteriorate, already know the impact that
mass illegal immigration is having on their communities, but even they may be shocked when they learn just how much of a drain illegal immigration has become.”
The Costs of Illegal Immigration to Californians focuses on three specific program areas because those were the costs examined by researchers from the Urban Institute in 1994.
Looking at the costs of education, health care and incarceration for illegal aliens in 1994, the Urban Institute estimated that California was subsidizing illegal immigrants to the
tune of about $1.1 billion. The enormous rise in the costs of illegal immigrants over the intervening ten years is due to the rapid growth in illegal residents. It is reasonable to
expect those costs to continue to soar if action is not taken to turn the tide.

“Nineteen ninety-four was the same year that California voters rebelled and overwhelmingly passed Proposition 187, which sought to limit liability for mass illegal immigration.
Since then, state and local governments have blatantly ignored the wishes of the voters and continued to shell out publicly financed benefits on illegal aliens,” said Stein.
“Predictably, the costs of illegal immigration have grown geometrically, while the state has spiraled into a fiscal crisis that has brought it near bankruptcy.
“Nothing could more starkly illustrate the very high costs of ‘cheap labor’ than California’s current situation,” continued Stein. “A small number of
powerful interests in the state reap the benefits, while the average native-born family in California gets handed a nearly $1,200 a year bill.”

2. 68% of all housed inmates in California prison's are illegal latinos costing the state approximately 14 billion per year to keep locked up.

3 47 % of all child molestation cases last year were from illegal aliens. "In those instances, the illegal immigrants typically gained access to the victims after having worked as a day laborer at or near the victims' homes," she says. "Victims ranged in age from 1 year old to 13 years old, with the average age being 6."

4. 617, or 41 %, were sexual homicides and serial murders by illegal aliens. "The murders were the worst of the sex crimes and were especially vicious. The most common method was for an offender to break into a residence and ambush his victims. Not only were victims raped, but some (6%) were mutilated. The crime scenes were very bloody, expressing intense, angry perpetrator personalities. Specifically, most victims were blitzed, rendered incapable of fighting back, and then raped and murdered. The most common method of killing was bludgeoning, followed by stabbing. Caucasians were more likely to become victims of sexual homicide committed by illegal immigrants. Hispanics were second, and African Americans were third."

5. Schurman-Kauflin states that the illegal alien population includes 240,000 sex offenders – a "conservative estimate," she says. She goes on to say, "This translates to 93 sex offenders and 12 serial sexual offenders coming across U.S. borders illegally per day." She points out the 1,500 offenders in her study had a total of 5,999 victims, an average of four victims for each sex offender and says, "This places the estimate for victimization numbers around 960,000 for the 88 months examined in this study."

6. The Schurman-Kauflin study noted that "Nearly 63% of the offenders had been deported on another offense prior to the sex crime." Note the word "deported," something that often comes up when we are talking about the crimes committed by illegal aliens. That means they were once removed from the country but came back in again to commit the crime! In this case, lack of any serious border security allowed the additional crime to happen – an additional 82,473 sex crimes – per year!

7. "Illegal immigrants who commit sex crimes first cross the U.S. border illegally. Then they gradually commit worse crimes and are continually released back into society or deported. Those who were deported simply returned illegally again. Only 2% of the offenders in this study has no history of criminal behavior, beyond crossing the border illegally. There is a clear pattern of criminal escalation. From misdemeanors such as assault or DUI, to drug offenses, illegal immigrants who commit sex crimes break U.S. laws repeatedly. They are highly mobile, work in low skilled jobs with their hands, use drugs and alcohol, are generally promiscuous, have little family stability, and choose victims who are easy to attack. Their attacks are particularly brutal, and they use a hands-on method of controlling and/or killing their victims."

8, "Women and girls are trafficked from many countries in Europe, Asia, Africa, Latin America, and the Middle East. Mexico is the number one source for young female sex slaves in North America. Tlaxcala, in Central Mexico serves as a hotbed for slave traders. Young women and girls are abducted, tricked, and sometimes sold by poor families into a caged life. Highly prized are 12 year old girls sneaking across the border into the United States. The girls are grabbed by Los Lenones, aka pimps, and dragged to unfamiliar areas where they are ‘broken in.' It is well known that this often occurs in Mexico. The initiation process entails 20-30 men per day having brutal sex with the girls and women. Victims are beaten, drugged, and repeatedly raped until their wills are broken. It is then that the sale is possible.

9, "Recently an outbreak of hepatitis traced to Chi-Chi's Mexican restaurant, in Pennsylvania was inexplicably traced to contaminated green onions, not the most obvious cause, undocumented food workers who harbored Hepatitis. For the most part, Hepatitis is a blood-borne, not a food-borne disease. The Hepatitis outbreak infected over 650 individuals, caused 9,000 Americans to undergo immune globulin shots, and killed 4 people.
If Americans found out restaurants can commonly infect their customers from food workers, it would be a serious blow to the restaurant industry. Better blame the green onions. Let's concede the onions, grown in Mexico, were contaminated from fecal material containing Hepatitis. Did all the green onions imported from Mexico end up in one single restaurant? There were no other outbreaks of Hepatitis anywhere elsewhere from green onions. There were 13 mexican restaurant workers who had Hepatitis. They were the likely source of the transmitted infection.

All these diseases and pathogens, and a plethora of others that are not endemic to the US, are being brought in by unscreened illegal aliens who then spread them to an unsuspecting population. These diseases will give you something to think about the next time you are eating at a restaurant with the grunt work being done by illegal aliens who didn't have medical screening before preparing and handling your food.

10. However, the direct cost of educating the children of illegal aliens is somewhere between $29 and $35 BILLION dollars a year. You can add in another billion or two for the costs of supplemental feeding programs and other welfare benefits administered through the schools but which are off the "education costs" in the school budgets.

Most illegal aliens are working in lower paying jobs are often sharing houses and apartments with other families. Most pay little or no state or federal income taxes and, because they have low incomes and frugal lifestyles, they pay little sales taxes as well. The local and state taxes illegal aliens pay, comes no where near paying for the education costs of their children. The difference is picked up by the tax paying public. Since many localities fund public schools through real estate taxes, this often means escalating taxes which put an enormous burden on elderly home owners living on fixed incomes.

11. Digressing for a moment, what the hell was a convicted, illegal alien sex offender even doing out of jail or not immediately deported – even if 63% do come right back - let alone roaming around the neighborhoods while on a registry! Has the judicial system in this country gone insane?

In any case, Operation Predator began on July 9, 2003, and resulted in 6,085 child predator arrests throughout the country - an average of roughly 250 arrests per month and eight arrests per day. While arrests have been made in every state, the most have occurred in these states: Arizona (207), California (1,578), Florida (255), Illinois (282), Michigan (153), Minnesota (190), New Jersey (423), New York (367), Oregon (148) and Texas (545).

While Operation Predator was a noble effort and ICE is to be commended, it only made a small dent in the criminal activity and number of horrific crimes being committed by illegal alien child sexual predators.

12. An article in the San Francisco Chronicle stated that Mexicans living in the U.S. send between $6 and $8 billion back to their families every year, making them the third-biggest legitimate force in the Mexican economy, after oil and tourism. Additionally, US taxpayers pay for all the direct and indirect costs of "housing" the Mexican illegal aliens. In essence, it's an unofficial form of foreign aide. Mexico isn't about to control its borders, since Mexicans fleeing their country for work in the U.S. send plenty of money back to their own country.

While the $6-8 billion number is often quoted, a fairly recent story in The Brownsville Herald, Banks seek stake in billions sent home, notes that some estimates place the amount of dollars going south in 2006 will be $45 Billion, which was up from an estimated $30 Billion in 2004.

Regardless of the amount, all that money is leaving the US economy and not creating additional job opportunities here. Additionally, all that money represents jobs Americans used to have.

13. "All the research suggests that the reason illegal aliens create large fiscal [deficits] for the country is not their legal status, but rather their educational attainment. Sixty percent of illegals are thought not to have even a high school education, another twenty percent, a high school education only. All the research suggests that people with relatively little education make relatively little money in the modern American economy ...[As] a consequence, they tend to pay relatively little in taxes, even if they are legal and on the books.
At the same time, [these individuals] tend to use a fair amount in public services, reflecting their lower incomes. I estimate illegals pay about $16 billion a year to the Federal Government in taxes ... the difference between what they pay in taxes and use in services is about $10 billion. So right now the net drain on the Federal Government alone from illegal families is about $10 billion. If we began to legalize [these individuals] and they began to pay taxes and use services like legal immigrants with the same level of education, the net fiscal drain would roughly triple to nearly $30 billion."

14. The United States currently has one of the lowest rates of TB in the world. Mexico has 10 times the rate and killing over 400,000 in mexico each year.

15. Chagas Disease (American Trypanosomiasis), endemic to South and Central America, is spread by infected triatomine bugs, known as the "kissing bugs," that bite people. It was unknown in the United States until fairly recently. It is now estimated that between 100,000 and 500,000 people in the US have Chagas Disease. Who is infected? Mostly illegal aliens.

Since Chagas Disease is basically unknown outside of the illegal alien community most doctors won't recognize it and the blood supply just started being screened for it. Most cases of Chagas Disease that occur in patients other than illegal aliens are thought to be contracted from tainted blood – blood sold by illegal aliens with Chagas Disease before the blood supply started being tested for it as of August of 2006.

16. HIV The number of illegal Mexican and Central American immigrants with HIV or AIDS is unknown, mostly because researchers rarely ask about immigration status. However, it is known that the rate of HIV infection among Latino women in California is about twice the rate of white women. State Trooper Koushel said migrants often cannot be conclusively identified when they're stopped for a violation or involved in an accident." "Many", he said, "are illegal aliens who carry fake or invalid driver's licenses". "Because of that", he said, "many fail to show up in court. It's almost like writing a ticket to a ghost."

20. How many hit and run accidents are there and what is the participation of illegal aliens? As reported by Deadly Roads, as of December 29, there were 1,544 killed and 105,078 injured in hit and run accidents in 2006 in the state of california.

Another victory for American workers in Arizona. Yesterday, the Ninth Circuit Court of Appeals upheld the get-tough employer sanctions law in the state. The law hits employers who knowingly hire illegal aliens with strict penalties and in some cases even strips businesses of their licenses. A lower court upheld the same law in February. But open-borders and amnesty groups along with the business lobby are considering yet another appeal.

In California, League of United Latin American Citizens has adopted a resolution to declare "California Del Norte" a sanctuary zone for immigrants. The declaration urges the Mexican government to invoke its rights under the Treaty of Guadalupe Hidalgo "to seek third nation neutral arbitration of ....disputes concerning immigration laws and their enforcement." Last year, Prince William County, Virginia passed an initiative to allow local police to check the immigration status of anyone in police custody. The county recently held its first immigration training session for local police officers. We’ll have a look inside the training.
