Mass. immigration reforms in peril after Brown win

BOSTON --For months, immigrant advocacy groups like the Chelsea Collaborative and Berkshire Immigrant Center have been gearing up to push lawmakers on state and federal immigration reforms.

They've held statewide forums, marched in Washington, D.C., and organized rallies with hopes of seeing the major immigration overhaul promised by Gov. Deval Patrick and President Barack Obama.

But after the historic election victory of Republican Scott Brown to the U.S. Senate, those illusions may be evaporating. Political observers say Brown, who ran on a platform opposing some of those reforms, has emboldened conservative voters, and they will likely table reforms in the near future.

"Much of the angry and frustration of voters, particularly those on the right, are clearly aligned with forces that oppose immigration reform," said Paul Watanabe, a political science professor at University of Massachusetts-Boston. "They are vocal opponents of anything other than enforcement."

Watanabe said it's now doubtful that Patrick and state lawmakers will spend political capital pushing any controversial proposals in an election year shortly after Brown's victory.

Patrick has said he is planning to seek re-election this fall, but is struggling with sagging poll numbers.

During his campaign, Brown said he opposed granting driver's licenses and in-state tuition rates to illegal immigrants -- ideas Patrick vowed to support in November after receiving recommendations from an advisory panel. As a state senator, Brown also introduced legislation that would have required proof of citizenship or right to work in the U.S. for wage enforcement cases.

"His record is concerning," said Eva Millona, executive director of the Massachusetts Immigrants & Refugee Advocacy Coalition, a group that represents 130 immigrant groups.

But Brown's positions excited conservative voters and won him endorsements and praise from national groups like Americans for Legal Immigration PAC, who hailed him for opposing "amnesty."

It's a dramatic shift from positions taken by his predecessor, the late Sen. Edward Kennedy. The Democratic senator sponsored a 1965 immigration law that changed the nation's demographic makeup by scrapping an immigration quota system that favored Western Europeans, and he remained for decades a "go-to" legislator for immigrant advocates.

After Brown's victory over Democrat Martha Coakley, the Federation of American Immigration Reform, or FAIR, sent out a statement arguing that Brown's win showed even Massachusetts voters oppose some of Kennedy's ideas on immigration and that it would be "suicide" for any politician to support certain reforms.

"If support for amnesty and benefits for illegal aliens won't fly in Massachusetts, it won't fly anywhere," said FAIR president Dan Stein. "Democrat or Republican, any candidate who 'leans into' amnesty in 2010, as some advocates advise, is likely to share Martha Coakley's fate."

Massachusetts is home to around 1 million foreign-born residents, or 14 percent of the state's population.

For their part, immigrant advocates in Massachusetts say they aren't giving up on prospects for state and federal immigration reform. But Millona acknowledged, after Brown's win, "It makes it harder for us."

Still, Millona said advocates hope to meet with Brown soon.

"In the state Senate, Mr. Brown did not always support issues that were important for immigrant communities," Millona said. "But the sober responsibility he demonstrated in his victory speech was very promising, as was his humble recognition that he has a lot to learn."

Millona said despite the upcoming election she still expects Patrick to keep his promise on reforms from an advisory panel report with 131 recommendations, which include suggestions for more English classes for Massachusetts immigrants and allowing undocumented students to pay in-state tuition.

The recommendations came more than a year after the governor sent the panel around the state to take public comment on immigration.

But Steve Kropper, co-director of the bipartisan Massachusetts Coalition for Immigration Reform, a group that opposes some reforms, said advocates can forget about some of those recommendations.

"We expect driver's license and in-state tuition for illegal immigrants to be left behind in the dust," said Kropper.

Patrick's office did not respond to requests for comment. In his State of the State address Thursday, Patrick did not mention immigration reform.

Carol Hardy-Fanta, director of the Center for Women in Politics and Public Policy at UMass-Boston, said while politicians may balk on reform proposals in the near future, it's unclear if immigrant voters and their advocates can sway state elections later.

Latino and Brazil immigrants, for example, are some of the only population groups to grow in the state in the last 10 years, she said.

"They are not a group that votes in large numbers in Massachusetts," said Hardy-Fanta. "Then again, Coakley didn't reach out to them."

Cost of teaching English learning students in SB County $34M

San Bernardino County public schools are spending more than $34 million in state and federal money this school year to educate English learners, a group whose population has doubled since 1995.
That amount doesn't include additional funding for services and programs available to English learners as well as other students.
Fueled by skyrocketing immigration over the past 15 years, the growth is forcing school districts to make dramatic changes in the classroom.
Districts are making huge investments in teacher preparation and training, hiring bilingual aides and purchasing bilingual materials to help teachers handle the demographic shift.
Some are concerned about the need to focus limited resources on students who may be in the country illegally or whose parents are illegal immigrants. Federal law requires public schools to provide a free kindergarten through 12th grade education to all students regardless of immigration status.
"A lot of parents came here illegally with their children or had children born here. It's creating a huge burden on the state," said Assemblyman Steve Knight, R-Palmdale, whose district includes Victorville and the High Desert. "We have to have so many of these classes that it takes away from the core classes that I'd like to fund."
Gil Navarro, a member of the San Bernardino County board of education, said that immigrant students and English learners are not a drain on the educational system.
"I get tired of people complaining about English learners receiving lawful services when our school districts are just following federal laws," Navarro said. "Taxpayer money is being put to good use because the funding will provide an educated workforce."
More than one-in-five kindergarten through 12th grade students in the county public school system is an English learner, according to the state Department of Education. Five school districts have English learner enrollments of at least 25 percent. The overwhelming majority of English learners - 94 percent - identify Spanish as their first language.
"With the growth, we have had to relook at how we approach our English learners," said Martha Duenas, coordinator of the Department of English Learner Services for the Fontana Unified School District. Nearly four-in-10 Fontana Unified students is an English learner.
"It's a challenge for schools to meet the needs of English learners," said Bertha Arreguin, director of language support services for the Colton Joint Unified School District, where one-quarter of students are English learners.
Most English learners were born in the United States, but their parents came here during the immigration boom that started in the 1980s, intensified in the 1990s and continued through the last decade, according to the Pew Hispanic Center, a nonprofit research organization in Washington, D.C.
The school-age population in the United States, which now stands at about 53 million, is expected to reach 58 million by 2020.
More than 80 percent of that growth - about 4.5 million kids - will be the children of immigrant parents, the center projects.
Growing up in immigrant families where English is not spoken at home puts added pressure on schools to help students meet increasingly rigorous academic requirements.
"Nationally, schools and school districts are going to be faced with more and more students who will need English learner services," said Richard Fry, senior research associate at the center.
Locally, school districts receive three pots of state and federal money to specifically to educate students with limited English skills.
Districts get an average of $244 per student from the state in economic impact aid. They also receive about $95 per student in federal Title III funds for immigrant students. An additional $100 per student is available for pupils in grades four through eight from the state-funded English Language Acquisition Program.
The three funding sources total $34.4 million when multiplied the number of students in each category.
English learners often use other services such as free and reduced lunch programs that are not included in that cost, school officials say.
There are other pools of money that support English learners who receive special education, as well as English learners who are in the Gifted and Talented Education program.
"It's money well-spent because the majority of these students are U.S. citizens," said Lupe Andrade, director of English learner programs in the Rialto Unified School District, where nearly one-in-three students is an English learner.
"We want them to leave our educational system well-educated so they can contribute well to our economy," Andrade said. "Language shouldn't be a barrier to educating somebody."
While programs have their differences, many districts spend their English learner money in similar ways.
A large chunk is devoted to staff development to provide teachers with strategies to engage English learners. Administrators are also trained to identify the needs of English learners.
Many districts have teacher coaches specializing in English learner students who act as a resource for their colleagues and supplemental classroom supplies.
Districts also set aside time every day for intensive speaking, listening, reading and writing in English.
Officials say support systems are critical to help districts whose large numbers of English learner students are one reason for their low test scores.
"We've had good growth (in test scores) with English learners," said Daniel Arellano, director of English learner programs for the San Bernardino City Unified School District, which has a 33-percent English learner population.
"We're aren't anywhere near where we should be," Arellano said, "but we are much better than we were."
The Ontario-Montclair Unified School District, where nearly half the students are English learners, offers a newcomer class to help immigrant students get acclimated to this country.
"Our job is to educate students and take them from wherever they're at and move them forward," said Karla Wells, the district's director of academic accountability.
Critics say illegal immigration is breaking the state's bank and that illegal immigrants shouldn't get special services.
In 2004, California spent $7.7 billion to educate illegal immigrants and the U.S.-born children of illegal immigrants, according to a report from the Federation for American Immigration Reform, which supports strict limits on immigration.
"The costs are astronomical," said Raymond Herrera, founder and president of We The People California's Crusader, a Claremont-based anti-illegal immigration group. "American posterity is very much in peril. We can't go on this way."

Tell Congress That Business Lobbyists Don't Speak for Most Businesses on Immigration

They oppose amnesty and more foreign labor importation by just about as big a margin as the rest of us!

We need to make sure that our Members of Congress and state legislatures know about this.

I need you to please send a bunch of faxes to your elected officials immediately to make sure they understand that all the business lobbyists in their offices don't speak for most business people.

Believe me, every one of these federal and state office-holders has felt the pressure of business lobbyists telling them that more and more foreign workers are necessary to keep business humming -- and that they should take it easy on illegal aliens because they are also needed by business.

But this new poll finds that only a small percentage of business owners and executives agree with the lobbyists.

TOP BUSINESS OFFICIALS AGREE WITH US

Given the choice between neutrally worded options, this is how top executives of businesses answered about the best way to deal with the 12 million illegal aliens in the country:

59% said to increase enforcement at the workplace and elsewhere to cause the illegal aliens to go home over time.
30% agreed with business lobbyists that the best solution is to legalize the illegal workers and put them on a path to citizenship.
These are the people who are the president, the vice president, CEO, COO, CPO, CFO and Treasurer of corporations!

They agree with us that the illegal aliens should be pushed from their jobs so that millions of unemployed Americans can have them.

Who knew?

For 30 years, the U.S. Chamber of Commerce and other national lobbying organizations have made a lot of Americans hate business because they have been the primary reason annual immigration numbers have quadrupled and illegal immigration has grown out of control.

How nice to find out that most business executives are far more patriotic, commuity minded and concerned about the effect of immigration on regular working Americans.

SMALL BUSINESS OWNERS AGREE WITH US EVEN MORE

Their answer to the choice was:

67% said to increase enforcement at the workplace and elsewhere to cause the illegal aliens to go home over time.
22% agreed with business lobbyists that the best solution is to legalize the illegal workers and put them on a path to citizenship.
The one national business group that has stood with Americans and represented its own constituents has been the NFIB (National Association of Independent Business).

Unlike most other business lobbying groups, the NFIB will only lobby if an overwhelming majority of its members agree. For years, it has polled its members on immigration and found pretty much what Zogby just found.

Because of that, NFIB has never lobbied for amnesty or more foreign workers. And it has been an endorser of Rep. Heath Shuler's (D-N.C.) SAVE Act to force all businesses to use E-Verify to keep illegal aliens from getting jobs.

The Zogby poll, though, shows that all Chambers of Commerce (local, state and national) should be working with us to pass SAVE and to reduce overall immigration -- if they are representing the majority of their members.

UNION HOUSEHOLDS THINK LIKE BUSINESS EXECUTIVES ON IMMIGRATION -- THEY WANT LESS OF IT

Starting a decade ago, national union leaders stopped protecting American workers from the wage depression and job loss of high immigration and began lobbying for amnesties alongside the Chamber of Commerce.

But we have always known that American union households have not agreed with the switch.

Zogby found that likely voters in union households gave this response to the choice about what to do with 12 million illegal aliens:

58% said to increase enforcement at the workplace and elsewhere to cause the illegal aliens to go home over time (compared to 59% for business executives).
28% agreed with business lobbyists that the best solution is to legalize the illegal workers and put them on a path to citizenship (compared to 30% for business executives).
By the way, the poll of ALL likely voters in America found them favoring enforcement over amnesty by 61% to 26%.

One of the standard arguments invoked by those in favor of massive immigration into the United States is that our country is founded on immigrants who have always been successfully assimilated into America's mainstream culture and society. As one commentator put it, "Assimilation evokes the misty past of Ellis Island, through which millions entered, eventually seeing their descendants become as American as George Washington."1 Nothing more vividly testifies against that romantic faith in America's ability to continuously assimilate new members than the events of October 16, 1994 in Los Angeles. On that day, 70,000 people marched beneath "a sea of Mexican flags" protesting Proposition 187, a referendum measure that would deny many state benefits to illegal immigrants and their children. Two weeks later, more protestors marched down the street, this time carrying an American flag upside down. Both protests point to a disturbing and rising phenomenon of Chicano separatism in the United States — the product of a complex of forces, among which are multiculturalism and a generous immigration policy combined with a lax border control. The Problem Chicanos refer to "people of Mexican descent in the United States" or "Mexican Americans in general." Today, there are reasons to believe that Chicanos as a group are unlike previous immigrants in that they are more likely to remain unassimilated and unintegrated, whether by choice or circumstance — resulting in the formation of a separate quasi-nation within the United States. More than that, there are Chicano political activists who intend to marry cultural separateness with territorial and political self-determination. The more moderate among them aspire to the cultural and political autonomy of "home rule". The radicals seek nothing less than secession from the United States whether to form their own sovereign state or to reunify with Mexico. Those who desire reunification with Mexico are irredentists who seek to reclaim Mexico's "lost" territories in the American Southwest.

Whatever their goals, what animates all of them is the dream of Aztlan. According to legend, Aztlan was the ancestral homeland of the Aztecs which they left in journeying southward to found Tenochtitlan, the center of their new civilization, which is today's Mexico City. Today, the "Nation of Aztlan" refers to the American southwestern states of California, Arizona, Texas, New Mexico, portions of Nevada, Utah, Colorado, which Chicano nationalists claim were stolen by the United States and must be reconquered (Reconquista) and reclaimed for Mexico. The myth of Aztlan was revived by Chicano political activists in the 1960s as a central symbol of Chicano nationalist ideology. In 1969, at the Chicano National Liberation Youth Conference in Denver, Rodolfo "Corky" Gonzales put forth a political document entitled El Plan de Aztlan (Spiritual Plan of Aztlan). The Plan is a clarion call to Mexican-Americans to form a separate Chicano nation: In the spirit of a new people that is conscious not only of its proud historial heritage, but also of the brutal "gringo" invasion of our territories, we, the Chicano inhabitants and civilizers of the nothern land of Aztlan from whence came our forefathers ...declare that the call of our blood is...our inevitable destiny.... Aztlan belongs to those who plant the seeds, water the fields, and gather the crops, and not to the foreign Europeans. We do not recognize capricious frontiers on the bronze continent.... Brotherhood unites us, and love for our brothers makes us a people whose time has come .... With our heart in our hands and our hands in the soil, we declare the independence of our mestizo nation. We are a bronze people with a bronze culture. Before the world, before all of North America, before all our brothers in the bronze continent, we are a nation, we are a union of free pueblos, we are Aztlan.

How Chicanos are Unlike Previous Immigrants Brent A. Nelson, writing in 1994, observed that in the 1980s America's Southwest had begun to be transformed into "a de facto nation" with its own culture, history, myth, geography, religion, education, and language. Whatever evidence there is indicates that Chicanos, as a group, are unlike previous waves of immigrants into the United States. In the first place, many Chicanos do not consider themselves immigrants at all because their people "have been here for 450 years" before the English, French, or Dutch. Before California and the Southwest were seized by the United States, they were the lands of Spain and Mexico. As late as 1780 the Spanish crown laid claim to territories from Florida to California, and on the far side of the Mississippi up to the Great Lakes and the Rockies. Mexico held title to much of Spanish possessions in the United States until the Treaty of Guadalupe Hidalgo ended the Mexican-American war in 1848. As a consequence, Mexicans "never accepted the borders drawn up by the 1848 treaty."

That history has created among Chicanos a feeling of resentment for being "a conquered people," made part of the United States against their will and by the force of arms. Their resentment is amply expressed by Voz Fronteriza, a Chicano student publication,
which referred to Border Patrol officers killed in the line of duty as "pigs (migra)" trying to defend "the false frontier."
Chicanos are also distinct from other immigrant groups because of the geographic proximity of their native country. Their physical proximity to Mexico gives Chicanos "the option of life in both Americas, in two places and in two cultures, something earlier immigrants never had." Geographic proximity and ease of transportation are augmented by the media. Radio and television keep the spoken language alive and current so that Spanish, unlike the native languages of previous immigrants into the United States, "shows no sign of fading."

A result of all that is the failure by Chicanos to be fully assimilated into the larger American society and culture. As Earl Shorris, author of Latinos: A Biography of the People, observed: "Latinos have been more resistant to the melting pot than any other group. Their entry en masse into the United States will test the limits of the American experiment...." The continuous influx of Mexican immigrants into the United States serve to continuously renew Chicano culture so that their sense of separateness will probably continue "far into the future...." There are other reasons for the failure of Chicano assimilation. Historically, a powerful force for assimilation was upward social mobility: Immigrants into the United States became assimilated as they rose in educational achievement and income. But today's post-industrial American economy, with its narrower paths to upward mobility, is making it more difficult for certain groups to improve their socioeconomic circumstances. Unionized factory jobs, which once provided a step up for the second generation of past waves of immigrants, have been disappearing for decades. Instead of the diamond-shaped economy of industrial America, the modern American economy is shaped like an hourglass. There is a good number of jobs for unskilled people at the bottom, a fair number of jobs for the highly educated at the top, but comparatively few jobs for those in the middle without a college education or special skills. To illustrate, a RAND Corporation study forecasts that 85 percent of California's new jobs will require post-secondary education. For a variety of reasons, the nationwide high-school dropout rate for Hispanics (the majority of whom are Chicano) is 30 percent — three times the rate for whites and twice the rate for blacks. Paradoxically, the dropout rate for Hispanics born in the United States is even higher than for young immigrants. Among Chicanos, high-school dropout rates actually rise between the second and third generations. Their low educational achievement accounts for why Chicanos as a group are poor despite being hardworking. In 1996, for the first time, Hispanic poverty rate began to exceed that of American blacks. In 1995, household income rose for every ethnic group except Hispanics, for whom it dropped 5 percent. Latinos now make up a quarter of the nation's poor people, and are more than three times as likely to be impoverished than whites. This decline in income has taken place despite high rates of labor-force participation by Latino men, and despite an emerging Latino middle class. In California, where Latinos now approach one-third of the population, their education levels are far lower than those of other immigrants, and they earn about half of what native-born Californians earn. This means that, for the first time in the history of American immigration, hard work is not leading to economic advancement because immigrants in service jobs face unrelenting labor-market pressure from more recently arrived immigrants who are eager to work for less. The narrowing of the pathways of upward mobility has implications for the children of recent Mexican immigrants. Their ascent into the middle-class mainstream will likely be blocked and they will join children of earlier black and Puerto Rican migrants as part of an expanded multiethnic underclass. Whereas first generation immigrants compare their circumstances to the Mexico that they left — and thereby feel immeasurably better off — their children and grandchildren will compare themelves to other U.S. groups. Given their lower educational achievement and income, that comparison will only lead to feelings of relative deprivation and resentment. They are unlikely to be content as maids, gardeners, or fruit pickers. Many young Latinos in the second and third generations see themselves as locked in irremediable conflict with white society, and are quick to deride successful Chicano students as "wannabes." For them, to study hard is to "act white" and exhibit group disloyalty. That attitude is part of the Chicano culture of resistance — a culture that actively resists assimilation into mainstream America. That culture is created, reinforced, and maintained by radical Chicano intellectuals, politicians, and the many Chicano Studies programs in U.S. colleges and universities. As examples, according to its editor, Elizabeth Martinez, the purpose of Five Hundred Years of Chicano History, a book used in over 300 schools throughout the West, is to "celebrate our resistance to being colonized and absorbed by racist empire builders." The book calls the INS and the Border Patrol "the Gestapo for Mexicans."
For Rodolfo Acuna, author of Occupied America: The Chicano's Struggle Toward Liberation, probably the most widely assigned text in U.S. Chicano Studies programs, the Anglo-American invasion of Mexico was "as vicious as that of Hitler's invasion of Poland and other Central European nations...." The book also includes a map showing "the Mexican republic" in 1822 reaching up into Kansas and Oklahoma, and including within it Utah, Nevada, and everything west and south of there.

At a MEChA conference in 1996, Acuna referred to Anglos as Nazis: "Right now you are in the Nazi United States of America." The effect of books such as those is to radicalize young Chicanos. As an example, although Chicano undergraduates at Berkeley lacked any sort of strong ethnic identity before entering college, in Berkeley they became "born again" as Chicanos because of MEChA and Chicano Studies departments. The strident rhetoric of intellectuals is echoed by some Mexican-American politicians. Former California state senator Art Torres called Proposition 187 "the last gasp of white America" and spoke of "reclaiming" Southern California. The Mexican government also contributes to the Chicano sense of separateness through its recent decision that migrants will not forfeit their Mexican citizenship by becoming U.S. citizens and are allowed to vote in Mexican elections. Multiculturalism and Immigration All of this is exacerbated by the U.S. government's immigration policy and a new ethic of multiculturalism that has become almost an official dogma in the mass media and in academe. Exponents of multiculturalism maintain that all cultures are equal, and that the United States must accept its destiny as a universal nation, a world nation, in which no one culture — especially European culture — will be dominant. "The ideal of multiculturalism is a nation which has no core culture, no ethnic core, no center other than a powerful state apparatus." The social ethic of multiculturalism is actively supported by an official government policy of "corporate pluralism" which militates against America's earlier ideal of assimilation. According to Gunnar Myrdal, "corporate pluralism" refers to a society where racial and ethnic entities are accorded formal recognition and standing by the state as groups in the national polity, and where political power and economic reward are based on a distributive formula that postulates group rights and defines group membership as an important factor in the outcome for individuals. By replacing individual meritocracy with group rewards, corporate pluralism "strongly discourages assimilation in the conventional sense because if a significant portion of one's rational interests are likely to be satisfied by emphasis on one's ethnicity, then one might as well stay within ethnic boundaries and at the same time enjoy the social comforts of being among people of one's own kind." Corporate pluralism is realized through such government policies as affirmative action, court-ordered busing, and bilingual education. In the case of the latter, by the late 1970s, bilingual education has become "a Hispanic institution." A bilingual establishment has been formed which "fights for jobs and perks" and is determined to maintain Spanish as both language and culture.* Being supported by government laws, that establishment cannot easily be dislodged.

Conclusion Chicanos are not the only ethnic groups in the United States who resist assimilation and are geographically concentrated in certain areas and cities. The Cubans in Miami and Chinese in Monterey Park are other examples, but neither group is large enough to practice autonomism or separatism. Chicanos in the Southwest, however, are great in numbers and "are producing spokesmen for...autonomism, separatism, and even irredentism." Since 1977, INS has apprehended over a million illegals a year, the majority Hispanics; anywhere from 2 to 5 million eluded the INS. By the early 1980s, the number of illegal aliens in the United States, mostly Hispanic, totalled 3 to 12 million. In 1980, the Census Bureau counted 14.6 million Hispanics in the United States, increasing to 15.8 million by 1982, and 17.3 million by 1985 — making America the 5th or 4th largest Spanish-speaking country in the world.27 According to the 1990 Census, Latin America accounted for 38 percent of America's foreign-born, well over half of whom were from Mexico. The real percentage is probably higher because illegal aliens avoid the census and most illegals are from Latin America. According to a report by the Urban Institute in 1984 entitled The Fourth Wave: California's Newest Immigrants, by the year 2000, 42 percent of Southern California's residents will be Caucasian, 41 percent Hispanic, 9 percent Asian and 8 percent black. Demographers Leon F. Bouvier and Cary B. Davis in Immigration and the Future Racial Composition of the United States expect that, by 2080, Hispanics (more than half Chicano) will constitute 34.1 percent of the total U.S. population, even if immigration were restricted to 2 million entrants a year from all areas of the world and birthrates of Hispanics converge with those of non-Hispanics. In 2080, Hispanics will be either a plurality or a majority of the population in California and Texas at 41.4 percent and 53.5 percent, respectively, assuming an influx of a conservative one million immigrants a year. Former Senator Eugene McCarthy, writing in 1987, had warned of a "recolonization". McCarthy's warning was sounded five years earlier by a historian of race relations, George Fredrickson. Speaking at a colloquium on race relations in 1982, Fredrickson observed that: There are two ways that you can gain territory from another group. One is by conquest. That's essentially the way we took California from Mexico and... Texas as well. But what's going on now may end up being a kind of recolonization of the Southwest, because the other way you can regain territory is by population infiltration and demographic dominance .... The United States will be faced with the problem that Canada has been faced with... and which our system is not prepared to accomodate. Mario Barrera, a faculty member of U.C. Berkeley's Department of Ethnic Studies, admitted that multiculturalism "would help prepare the ideological climate for an eventual campaign for ethnic regional autonomy." In January 1995, El Plan de Aztlan Conference at UC Riverside resolved that "We shall overcome...by the vote if possible and violence if necessary." The rise of Mexican irredentism as a serious political movement "awaits only the demographic transformation of the Southwest." As an article entitled "The Great Invasion: Mexico Recovers Its Own" in 1982's Excelsior, Mexico's leading daily newspaper, put it: The territory lost in the 19th century by...Mexico...seems to be restoring itself through a humble people who go on settling various zones that once were ours on the old maps. Land, under any concept of possession, ends up in the hands of those who deserve it.... [The result of this migration is to return the land] to the jurisdiction of Mexico without the firing of a single shot. Immigration Control Law Struck By Fed Appeals Court

Siding with powerful business interests that profit from hiring illegal aliens, a federal appellate court has struck down as unconstitutional key employment provisions in Oklahoma’s strict immigration control law.
The 2007 measure (Oklahoma Taxpayer and City Protection Act) aims to curtail the state’s illegal immigration crisis by limiting public benefits to illegal aliens, requiring deportation for those arrested and cracking down on businesses that employ them. That portion of the law subjects employers to stiff penalties if they are caught hiring illegal immigrants.
It prohibits firing workers who are in the U.S. legally while retaining undocumented workers, requires businesses to obtain documents proving that employees of private contractors are authorized to work in the country and requires companies with government contracts to use a federal database known as E-Verify to check eligibility of job seekers.
In mid 2008 a federal judge (Robin Cauthron) in Oklahoma City blocked all three employment provisions, ruling that the state measure preempts federal law on immigration and that the state cannot create or impose guidelines that conflict with the Constitution or federal law.
The state appealed and this week the Denver-based 10th U.S. Circuit Court of Appeals struck down two of the three employer stipulations, essentially agreeing with the lower court’s assessment that they cannot be enforced and are likely unconstitutional. Businesses forced to comply with the law will face significant risk of suffering financial harm, the justices wrote in their decision.
Influential state and national business groups, including the U.S. Chamber of Commerce, filed the lawsuit in an effort to get rid of the measure. However, the appellate court did rule in favor of the portion of Oklahoma’s law that requires employers with government contracts to use E-Verify to check the eligibility of its workers.
Last October a different federal judge (James Payne) dismissed a separate lawsuit aimed at killing Oklahoma’s law, which also denies state identification cards to illegal immigrants, in its entirety. Filed on behalf of a group of anonymous illegal immigrants, that suit claimed that the state measure discriminates against all immigrants but Judge Payne disagreed.
In his strongly worded ruling, Judge Payne said that anonymous illegal alien plaintiffs do not have standing or the right to sue to prevent the law’s implementation. He also pointed out that the illegal immigrants filed the suit in order to remove any barriers the state had erected to their continued violation of federal laws. “These illegal alien plaintiffs seek nothing more than to use this court as a vehicle for their continued unlawful presence in this country,” he wrote.

Day Laborers Sue Over Right To Solicit Work On Street

In the latest of many bold legal actions taken by illegal immigrants against local governments nationwide, a group of undocumented day laborers are suing a southern California city for banning them from seeking work on public streets.
The anti-solicitation ordinance is unconstitutional and violates the civil rights of the illegal aliens, according to an 11-page complaint filed this week in federal court. The defendant is Costa Mesa, a suburban city of about 115,000 residents located some 40 miles southeast of Los Angeles.
Passed in 2005, the Costa Mesa law states that it's illegal for any person to stand on a street or sidewalk and actively solicit employment, business, or contributions from any person in a motor vehicle traveling along a street. It also prohibits any person in a motor vehicle traveling along a street to solicit employment of any person standing on a street, to solicit from or make contributions to any such person, or to solicit and engage in a business transaction.
This violates the first and fourteenth amendments to the U.S. Constitution, the complaint asserts, because it regulates speech on the basis of its contents—banning messages soliciting employment, business and contributions—but allows people to stand on sidewalks with signs, distribute literature and talk to others in lawfully parked vehicles.
The ordinance is “simply illegal,” according to the civil rights attorney representing the day laborers from the Asociacion de Jornaleros and the Colectivo Tonantzin, whose members have been restricted from peaceably expressing their need and avail. “Not only does it discriminate against day laborers but it prohibits protected speech,” the lawyer asserts.
Another representative of the illegal immigrants who heads a renowned Latino civil rights group (Mexican American Legal Defense and Education Fund—MALDEF), points out that free speech belongs to everyone in society. Day laborers seeking work have as much right to express themselves as the largest corporation employing hundreds of thousands, he says.
The lawsuit was sparked by the arrest of a dozen illegal alien day laborers last year. Costa Mesa police posed undercover as employers and busted the illegal immigrants violating the city ordinance banning solicitation. The lawsuit not only asks Costa Mesa to halt the measure, it asks the city to pay the arrested illegal immigrants damages and attorneys’ fees.
In the last few months alone, illegal aliens across the nation have sued various law enforcement agencies for violating their constitutional rights. Among them is an Ohio sheriff who helped deport a Mexican with false identification cards, a Maryland sheriff who arrested an illegal Salvadoran woman and federal agents who apprehended a group of illegal aliens in a Connecticut immigration raid.
In Oregon an illegal alien actually sued a state agency for denying her costly public services based on her immigration status. That case was resolved a few weeks ago when a state appellate court rejected the illegal alien’s claim that the agency’s director overreached by creating an eligibility requirement—that beneficiaries be authorized to work in the United States—not granted by Oregon’s legislature.

U.S. Census Director Tour Assures Illegal Immigrants

Keeping with the Obama Administration’s mission to conduct the most diverse outreach campaign in history, the director of the U.S. Census Bureau is touring Mexican border towns with high illegal immigrant populations to personally assure that those who fill out questionnaires this spring will not be deported.
"This is a safe thing for everyone to do regardless of your immigration status,” the president’s handpicked census director (Robert Groves) told residents of a renowned illegal alien “colonia” in south Texas this week. He visited several dilapidated makeshift homes off of a dirt road in a Laredo neighborhood called San Carlos to stress that census data will be kept confidential and not turned over to immigration authorities.
Even if the president of the United States asks him for their census forms, Groves told the Spanish-speaking crowd, he can refuse because the law says the forms must be kept private. If he violates that sacred law, Groves further informed the attentive illegal immigrants, he can go to prison. Besides, citizenship status is not even asked on the census questionnaire, assured the Texas congressman (Chicano rights activist Henry Cuellar) who accompanied Groves on this particular jaunt.
The census director is also giving illegal immigrants across the country a lesson in basic civics by explaining that hundreds of billions of federal dollars are allocated to state and local governments based on population. Being included in the decennial count will in turn allow them to receive more public benefits; “We want to count you and your family can benefit from the services," Groves is telling illegal aliens.
This marks the latest of many administration efforts to cater to illegal immigrants. A few weeks ago the government launched an unprecedented $133 million advertising campaign—in dozens of languages—to promote the census with the Spanish ads assuring the decennial count is confidential and cannot divulge respondents’ immigration status.
The never-before-seen promotional blitz includes television commercials, print and outdoor ads as well as online advertising. Hundreds of ads have been drafted in 28 languages, including two Chinese dialects, Russian, Arabic and Tagolog. The Spanish advertisements, distributed on national television and print media, are of particular interest because they guarantee the safety of illegal aliens who fill out the census forms.
A few months ago the government announced that, in an effort to reach out to illegal aliens, it is spending $26 million to send Spanish-language questionnaires directly to homes for the first time in history. In past years, participants could request special forms in several languages—including Spanish, Chinese, Korean and Vietnamese—but the effort marks the first time that the government sends to entire regions census questionnaires in a language other than English.

20,000 Latino churches Boycott US census
High-stakes battle that could affect California's share of federal funding and political representation, immigrant activists are vowing to combat efforts by a national Latino clergy group to persuade 1 million illegal immigrants to boycott the 2010 U.S. census.
The Washington, D.C.-based National Coalition of Latino Clergy & Christian Leaders, which says it represents 20,000 Latino churches in 34 states, recently announced that a quarter of its 4 million members were prepared to join the boycott as a way to intensify pressure for legalization and to protect themselves from government scrutiny.
"Before being counted, we need to be legalized," said the Rev. Miguel Rivera, the coalition's chairman and founder.

But the boycott call has infuriated many Latino organizations. La Opinión, in a recent editorial, denounced it as a "dangerous mistake" that "verges on political suicide" while an official with the National Assn. of Latino Elected and Appointed Officials called it "wildly irresponsible."
"This is a phenomenal step backward in the strides we have made to make sure we are equal," said Arturo Vargas, executive director of the Los Angeles-based Latino officials group.
The decennial census, which counts all people regardless of immigration status, is used to allocate federal funds for education, housing, healthcare, transportation and other local needs. By some estimates, every person counted results in $1,000 in federal funds.
The census is also used to apportion the 435 seats in the U.S. House of Representatives, which are based on a state's population.
According to a study in 2003, California's sizable illegal immigrant population allowed it to gain three House seats it might otherwise not have received. The state's illegal immigrant population also caused Indiana, Michigan and Mississippi to each lose one of their seats and prevented Montana from gaining a seat.
The study by the Center for Immigration Studies, a Washington, D.C.-based research group that promotes immigration restrictions, also argued that the illegal immigrant population skewed the "one man, one vote" principle in elections.
In 2002, the study found, it took almost 100,000 votes to win the typical congressional race in the four states that lost or failed to gain a seat, compared with 35,000 votes to win in immigrant-rich districts in California.
Back in 1988, the effect on apportionment, which also affects the Electoral College, prompted a lawsuit by 40 members of Congress, Pennsylvania and the Federation for American Immigration Reform to prevent the Census Bureau from counting illegal immigrants. The complaint was dismissed by the U.S. Supreme Court for lack of standing.
People who have no right to be in this country should not be counted," said federation President Dan Stein. "It's awfully hard to explain to U.S. citizens why they keep losing political representation to states like California because of people who broke immigration laws."
He said his group was concerned that federal funds obtained in part through the counting of illegal immigrants would be used against them to increase arrests and harassment by local law enforcement.
Rivera also said he wanted to use the boycott as a way to pressure Congress to pass legislation offering legalization to illegal immigrants.
So far, his group appears to have gained little traction in California. A group of affiliated Latino pastors plans to meet in the next week or two to discuss the boycott call but has made no decision yet, according to Jose Caballero, a Camarillo minister But other Latino leaders say they are nervous about the boycott.
"The fact that they are getting a lot of media attention concerns us that they could do a lot of damage," said Brent Wilkes, executive director of the League of United Latin American Citizens in Washington, D.C.
Using the same slogan as their successful citizenship campaigns -- "Ya es Hora," or "It's Time" -- Spanish-language media, community groups, labor unions and churches plan to launch a far-reaching campaign urging mass participation in the census.
Boycott or not, they have their work cut out for them. Although the Census Bureau by law must keep information confidential, that message has not entirely gotten through.

"Ladies and gentlemen, the sanctuary cities and the people that support them are violating the laws of the United States of America. They're violating 8 USC section 1324 and 1325, which is a felony -- [it's] a felony to aid, support, transport, shield, harbor illegal aliens," Walsh stated. Walsh said his analysis indicating there are 38 million illegal aliens in the U.S. was calculated using the conservative estimate of three illegal immigrants entering the U.S. for each one apprehended. According to Walsh, "In the United States, immigration is in a state of anarchy -- not chaos, but anarchy."

Today, Americans face an unprecedented illegal immigration crisis facilitated by multi-billion dollar drug and human importing cartels as well as corporations which are inducing the invasion by aiding and abetting illegal aliens and using their influence on the Executive Branch and elections to paralyze existing immigration laws supported by over 80% of the American citizenry.

These events are not random and chaotic. Massive illegal immigration is the result of non-enforcement and under-enforcement of our existing immigration laws.

Supporters of illegal aliens love to claim that our immigration system is broken. The system is not broken. Elite financial and political business interests who could care less about the death and devastation they are causing Americans have sabotaged the system. Their profits continue to rise as they send the rest of America spiraling downward on a path to anarchy and Third World quality-of-life conditions.

By using their influence to suspend our existing laws, these globalist special interests have deprived all Americans of political representation as well as their votes, their voice, and a functioning Republic for which our flag stands.

When the laws of the American people – debated and voted on by their duly-elected Congressional Representatives and signed into law by the President – go intentionally under-enforced by the Executive Branch, all of the principles, sovereignty, and self-governance of Americans are derailed. The will of the American public, the existing laws, the US Constitution, and the borders of our great nation are perceived as market hindrances to the global elite. We the people of America are perceived as peasants and subjects beneath the power of their influence.

The American public has spoken through our lawmakers and in numerous polls. A super majority of Americans want our existing laws enforced, those responsible for illegal immigration fined and/or imprisoned, the borders secured, and illegal aliens deported from the United States for many years or permanently. These fact remain, despite several politicized polls which attempt to manufacture consent and make you believe such views represent a minority.

The truth is that most Americans want the illegal aliens to return to the nations of which they are citizens. The rallying cry is: "Illegals Go Home!"

We could easily list 101 reasons why Americans are upset about illegal immigration. Most are concerned about the 4,000+ preventable deaths of Americans by the criminal acts of illegal aliens on our soil each year. No corporate propaganda will change the fact that most Americans do not want to surrender or capitulate to the lawless masses rushing into our nation.

No poll or politicized source is needed to prove this point because the decision is based upon our nation's successful history and basic common sense. The answer is based on something that every judge, lawmaker, and even street thug knows. The penalties must outweigh the benefits if you want to deter any action.

It is common sense and common practice in America that for any law to be a deterrent, two important factors are in play. First, the laws must be enforced, and second, the penalties for any crime must exceed the benefits to those breaking the law.

It is truly amazing that we find ourselves as a nation having to explain these basic foundations of law to corporations and politicians in the year 2007 despite their existence since the dawn of civilization! Can you imagine what would happen in America if the penalty for robbing a bank was that you had to return half of the money you stole if, and only if, you were apprehended for the crime? What if the penalty for car theft was paying a $2,000 fine if you were caught with the stolen vehicle?

The answers are clear. Within a month, you would not have a bank open in America and you would not be able to keep a car worth more than $2,000 in your driveway for more than a week. How many millions of people would quickly take up the careers of bank robber and car thief once the rewards for the crime were higher than the penalty?

If American businesses and homes left their windows and doors unlocked each night and robbers were merely removed by police when detected – only to try again the next night – what do you think would happen? If big, global businesses practiced the same non-enforcement of security similar to the lack of border security and lack of immigration enforcement they have facilitated for Americans, they would be out of business in a matter of days or weeks. If they left their doors unlocked at night and just pushed people back to the street, America would quickly descend into such chaos and anarchy that we would be unable to sustain a population of 300 million. Our population would take a hit similar to the impact of the Black Plague on Europe, and we would quickly enter a new dark age.

Since illegal aliens can never afford to compensate Americans for what they have taken, they must go. We do not need to go door to door looking for illegals to deport in America. Attrition through enforcement works. Illegal aliens are leaving the states of Georgia and Pennsylvania in droves, not because they are enforcing the laws but because they have simply announced they plan to start!

Unfortunately, the current state of affairs in America has illegals flooding in by the millions each year and many law-abiding Americans fleeing the states of California and Texas and many towns and cities in search of more safety and security. Many Americans are on the run and finding few places left to run to.

The illegal aliens are sending a clear message on the streets of Los Angeles and other major urban centers. They are saying: "This is our land. White, black, and legal Hispanics get out!"

This is great news for the housing and real estate markets, Wal-Mart, and McDonalds. They are growing the economy using rapid population growth. This is great news for big corporations and bad news for Americans.

Attrition through enforcement will work. In fact, if President George Bush were to announce on national television that America would begin securing our borders and enforcing our existing laws in one month, so many illegal aliens would leave America that Mexico would have to set up refuge stations!

Another important reason that the illegal aliens must leave for the long term is that they'll return to their home communities with a message for their neighbors that their ill-gotten gains did not pay off in America. This is the only thing that will stop, or slow, the flow. Deporting illegal aliens and sending them packing is the only real way we can put a stop to this crisis.

The politicians in DC are very aware that Americans want the illegal aliens to go. That is why their latest Scamnesty legislation includes a “touchback” provision. Under these laws, the illegal aliens can hop across the Mexican or Canadian borders where special "Ellis Island" stations are set up for them to pay a fine, receive new documentation and be back in the US within days or hours.

The lunatics advocating this plan are counting on Americans to be so stupid and so gullible that they can say, "Look, the illegals left and walked back in legally. Problem solved!" They are eager to pretend to accommodate the American desires for the illegals to leave while quickly returning their slave labor force to our nation.

They know that Americans want illegals to leave and get behind a long line of legal immigrants waiting to enter the US, including millions of people who have been waiting 5-10 years. These politicians and the illegal aliens need to be shown the way to the back of the line. The back of the line is back in the country in which they are citizens, 5-10 years down the road behind all of the talented and law-abiding people who respect our laws.

If these traitorous corporations and politicians succeed in setting up these Ellis Island stations for “Operation Touchback," the revered symbol of Ellis Island will take on a new meaning that Americans see with contempt and resentment. Ellis Island will become a name associated with the horrendous betrayal of free Americans and the deathblow to the American Republic. This is a symbol of America’s surrender and the subjugation of all her people.

If we allow the politicians in DC to sign off on the many Guest Worker, Temporary Worker, Path to Citizenship, Amnesty, Scamnesty bills written by the US Chamber of Commerce, then no wall with an army on top of it will stop the next 20 million from crashing down on our country. We will have signaled that America is weak and will capitulate and accommodate. Already, the word is out in Central and South America that they can come and stay. Each time President Bush has opened his mouth about such programs, the US Border Patrol reports massive spikes in illegal crossings.

Since there is literally no end to the stream of illegals who want to be in America, this will be the end of America as we have known it and as history has praised it.

In the past, when America has cracked down on illegal immigration and the American people have signaled they want the immigration brakes applied, the policies have worked. New laws written near the turn of the 20th century greatly reduced the amount of immigration into America. When Presidents Franklin Roosevelt and Dwight Eisenhower launched large deportation campaigns in the 1950s and 1930s, illegal immigration slowed to minuscule levels as a result.

Whether you agree or disagree with the decisions of the past, these policies were part of the successful formula that have led America to become the most opulent and successful civilization in human history.

While some argue that these enforcement measures were racist and that some American citizens of different races were improperly deported at the time, we now have the technology and methodology in place to assure that American citizens and legal immigrants are not improperly affected by our immigration enforcement efforts.

The difference in 2007 is that the globalist corporations that have hijacked the American government want to stop the American citizenry from applying the brakes this time. They have taken away our ability to determine who can enter our nation and our ability to stop armed and unarmed invasions as granted by the US Constitution.

To take away the self-governance of Americans is to kill the very thing that has made us such a great and successful nation.

In a time of crisis like this, we must stand firm on the principles that have made America an attractive and great nation. We must stand firm on the rule of law. The law must be applied equally to big corporations and illegal aliens alike lest we all become slaves subject to the plans of masters instead of a free and empowered citizenry.

Nancy Pelosi’s socialist political views are exactly what have kept her elected in San Francisco, along with the flow of union campaign money. The staunch “union supporter” Pelosi has even received the Cesar Chavez Award from the United Farm Workers Union. But her $25 million Napa vineyards and winery, she and her husband own is a non union shop.

The hypocrisy doesn’t stop there. Pelosi has received more money from the Hotel Employees and Restaurant Employees union than any other member of Congress in recent election cycles.
The multi millionaire investors own a large stake in an exclusive resort hotel in Wine Country, the Napa Valley Auberge Du Soleil Resort. It has more than 250 employees. But none of them are in a union, according to Peter Schweizer, author of “Do As I Say, (Not As I Do) – Hypocrisy of Democrats” and a regular contributor to the New York Times.

Pelosi is also partners in a restaurant chain called Piatti, which has 900 employees. The chain is – you might have guessed — a non union shop AND HIRES HUNDREDS OF ILLEGALS.

The 68 year old Pelosi has spent more money on facelifts and cosmetic enhancements, and Armani suits than any self centered, faded Hollywood star. But does Pelosi represent your 68 year old grandma’s values?

She has served on the executive committee of the Progressive Caucus, a socialist organization that, until 1999, was hosted by the Democratic Socialists Of America. They were asked to hide their connection after reviewing focus groups that show Americans still have negative feelings about Socialists. The Minuteman Project, founded by Jim Gilchrist (who is also the co author of the book Minutemen: The Battle to Secure America’s Borders), is made up of citizen volunteers who watch our border with Mexico and report illegal entry to the border patrol. For performing that thankless task in full compliance with the law, Gilchrist and his colleagues have been falsely maligned as fascists, racists, and even murderers. They have been driven off the speaker’s platform at Columbia University and vilified by Leftist politicians and their handmaidens in the liberal press.

So it was no surprise that the mainstream media chose to ignore a recent press release, issued by his publisher, in which Gilchrist asked the question about Nancy Pelosi’s ethics that should be on the minds of every law abiding American – including those immigrants who are following the law to become citizens here the proper way: “Do we really need a House Speaker whose every action is calculated to enhance her own financial interests, instead of focusing on how porous borders will affect the security of everyday American citizens?”


Gilchrist did not stop there. He demanded an investigation into Pelosi’s “economic stake in just the kind of illegal alien exploitation that we deplore in Minutemen.” But you would never know it from the liberal media, who while ignoring this demand have had no compunctions in calling for Speaker Hastert’s head in the wake of the Foley page controversy.

Gilchrist was reacting to my report several weeks ago in FrontPage Magazine that Pelosi – who owns non union vineyards in Napa Valley where grape picking depends chiefly on the availability of cheap foreign labor – is doing everything she can to help open the floodgates to more illegal immigration. And she wants the American taxpayers to pay their way. As even more proof of this than I previously reported, Pelosi does not want employers like her to be required to pay the cost of illegal aliens’ hospital care. She voted against a bill that would make employers liable for the reimbursements if an undocumented employee seeks medical attention. And she voted in favor of rewarding illegal aliens from Mexico with Social Security benefits.

At the same time, Pelosi has led the Democratic opposition to any effective border controls or documentation requirements. She opposed the Secure Fence Act of 2006, signed into law by President Bush, and voted against final passage of a border security and enforcement bill in 2005 which required that all businesses must use an electronic system to check if all new hires have the legal right to work in this country. She voted against a bill to bar drivers' licenses for illegal aliens in 2005. This year she opposed legislation requiring presentation of a legitimate government issued photo ID to prove eligibility to vote, claiming that “there is little evidence anywhere in the country of a significant problem with non citizen voters.” She is dead wrong. For example, an accused terrorist by the name of Nuradin Abdi was just recently reported to have illegally registered to vote at the Ohio Bureau of Motor Vehicles. Nuradin Abdi was indicted earlier this year as part of a conspiracy to blow up the Columbus Mall.

How many other terrorist suspects may have slipped through the system because Leftists like Pelosi oppose any meaningful screens? Instead she continues to advocate our recognition of the flimsy, non validated ID card that the Mexican consulates provide to illegal aliens before they cross over our border, called the “matricula consular”, which gives them phony documentation to set up bank accounts, apply for jobs, obtain social benefits, board airplanes, identify themselves to police, enter buildings that require IDs, obtain drivers’ licenses and then perhaps use those drivers’ licenses to try to illegally register to vote in our elections.

Pelosi also believes in giving sanctuary to illegal aliens. She opposed legislation to deny federal homeland security funding to state and local governments who refuse to share information they learn about an individual's immigration status with Federal immigration authorities. Pelosi’s hometown of San Francisco is one of the sanctuary cities she voted to protect for the benefit of illegal aliens. Pelosi even voted against strengthening our immigration law with regard to the deportability of alien terrorists.

Jim Gilchrist cut to the chase with this devastating observation that the mainstream media does not want you to read:


"As we’ve shown again and again in ‘Minutemen,’ the Democrats aren’t just hypocrites, but are working actively to subvert our legislative system to their own ends. Pelosi sees Jim Gilchrist’s Minutemen Project as a threat to her pro illegal alien agenda. More illegal aliens mean more votes for the Democrats and more grape pickers for Napa Valley vineyards like hers. So she even voted against a measure that would have cut off the use of U.S. taxpayers’ funds to tip off illegal aliens as to where the Minutemen citizen patrols may be located! She obviously wants to see the Minutemen put out of business – permanently. She can count on the liberal press to distort the work of the Minutemen and to keep out of the public eye Gilchrist’s pointed questions about her motivations for helping illegal aliens during the run up to the mid term elections that may make her the next Speaker of the House.

Gilchrist, of course, is accustomed to being vilified and prevented by the Left from getting his message out. In early October, he was prevented from finishing his speech at the "Minutemen Forum" sponsored by the Columbia College Republicans. Gilchrist had spoken for just a few minutes and managed to utter the words “I love the First Amendment” when a group of radical protestors took the stage and interrupted him, displaying a big banner saying "There are no illegals." More protestors then stormed the stage. Chaos erupted and the audience members who had come to hear Gilchrist speak never got the chance, which was precisely the protestors’ objective. As reported online by the staff of Columbia’s undergraduate newspaper, “a mosh pit of triumphal students and community members danced and chanted outside, "Asian, Black, Brown and White, we smashed the Minutemen tonight!" They also put out a statement declaring:
“The Minutemen are not a legitimate voice in the debate on immigration. They are a racist, armed militia who have declared open hunting season on immigrants, causing countless hate crimes and over 3000 deaths on the border. Why should exploitative corporations have free passes between nations, but individual people not? No human being is illegal.” (Emphasis added)

We have come to the point in this country where a bunch of radical protestors get to decide who is and who is not a legitimate voice in the debate on as critical a public policy issue as immigration. Such Leftists think that migration in a borderless world is a basic human right. They want no barriers, no guards, and no proof of lawful residency. They certainly do not want the Minutemen watching the border and reporting illegal entry to the authorities.

Leftist slogans like “no human being is illegal” are red herrings. It is not the human being who is illegal; it is what the human being does that may be illegal. One’s conduct is the test, not simply who one is. Immigrants who follow our rules are welcome here. Those who do not abide by our laws have no right to be here. A person who breaks into your house without your permission does not deserve room, board and a job as a reward, even if the intruder may be much poorer than you. He has broken the law and deserves to be punished for what he has done. Our country’s boundaries and rules for entry and residency similarly define who is permitted to be here and how we choose to protect ourselves. We are a land of immigrants, but we are also a land of laws with certain core values. Those seeking to enter our country and remain here must learn to accommodate to our laws and values, not the other way around. That is the way prior generations of immigrants did it, including those who passed through Ellis Island. Why should the law be thrown aside now?

What we are witnessing is a frontal challenge to our nation’s sovereignty. Mexico’s Foreign Secretary wants to drag us before the United Nations for intending to build a fence on our side of the border with our money to keep out aliens who seek to enter our country illegally. They will probably get a sympathetic ear as some UN bureaucrats believe there should be no such thing as “illegal” immigrants in the first place. For the first time in our history, Americans are being asked to cede the right to decide how we define ourselves as a nation and protect our own borders to a globalist governance body. Will Pelosi lead her liberal loyalists as House Speaker to support the UN against America’s right to control its own borders? Do we really want to risk finding out?

Bill aims to fix farmworker shortage

WASHINGTON - California's Democratic senators introduced legislation Wednesday that would put some illegal immigrant farmworkers on a path to citizenship and revamp a little-used agricultural guest-worker program.
Flanked by Republican colleagues, immigrant advocates and a California pear grower, Dianne Feinstein and Barbara Boxer presented the bill as a matter of survival for labor-strapped farmers.
``Today, many farmers are on a precipice,'' Feinstein said. ``Whether they survive to plant another season is determined largely on one simple question: Will there be enough workers to bring in the harvest?''
About 1 million undocumented laborers work California's 76,500 farms, making up about 90 percent of the state's agricultural payroll. Tougher enforcement along the southern border and inside the country has left farmers scrambling for enough hands at harvest time, especially since undocumented workers tend to leave agricultural work for higher-paying jobs in the construction, restaurant and hospitality industries.
If the labor shortage continues, the American Farm Bureau Federation estimates that California losses would start at $3 billion a year and could climb as high as $4.1 billion. California farms generate $34 billion in revenue a year.
Toni Scully, a Lake County pear grower, said he lost large amounts of a nearly flawless crop last year. ``It is extremely painful for a farmer to have to see a portion of his crop abandoned, or fruit culled out because it was harvested too late,'' Scully said. He estimated that about 25 percent of the county crop was lost in 2006 because of labor shortages.
Backers said the bill, which has four co-sponsors, has the votes to pass but also said they would prefer to see it as part of a larger immigration package.
The legislation would allow illegal immigrants who have worked in agriculture for at least 150 days over the past two years to receive a ``blue card,'' which would entitle them to temporary legal-resident status. A limit of 1.5 million blue cards would be distributed over five years, when the program would end.
Blue-card holders would be allowed to travel in and out of the United States. To be eligible to apply for permanent legal-resident status, they would have to continue doing farm work for another three years at 150 days a year, or for another five years at 100 days a year.
The program would require applicants to pay $500, show that they are up to date on their taxes and have not been convicted of a serious crime.
The bill also would revamp the H2-A guest-worker program to make it easier and less expensive for growers to use and to protect them from lawsuits. With more than 300 pages of regulations, the current program requires farmers to go through 60 steps to get workers from overseas.
``Only 2 percent of American agriculture uses the program because it is so difficult to use,'' said Sharon Hughes, executive vice president of the National Council of Agricultural Employers.

Meet Your New Farmer: Hungry Corporate Giant

Forget buckets of blood. Nothing says horror like one of those tubs of artificially buttered, nonorganic popcorn at the concession stand. That, at least, is one of the unappetizing lessons to draw from one of the scariest movies of the year, “Food, Inc.,” an informative, often infuriating activist documentary about the big business of feeding or, more to the political point, force-feeding, Americans all the junk that multinational corporate money can buy. You’ll shudder, shake and just possibly lose your genetically modified lunch.
Divided into chapters dedicated to points along the commercial food chain — from farm to fork, to borrow a loaded agribusiness phrase — the movie is nothing if not ambitious. “There are no seasons in the American supermarket,” the unidentified voice intones in the opening scene, as the camera sweeps the aisles of one such brightly lighted, heavily stocked if nutritionally impoverished emporium. From there the director Robert Kenner jumps all over the food map, from industrial feedlots where millions of cruelly crammed cattle mill about in their own waste until slaughter, to the chains where millions of consumers gobble down industrially produced meat and an occasional serving of E. coli bacteria.
The voice in the opening belongs to the ethical epicurean and locavore champion Michael Pollan, author of “In Defense of Food” and “The Omnivore’s Dilemma,” as well as a contributing writer to The New York Times Magazine. (Somewhat confusingly, the movie uses voice-overs without clearly identifying who’s issuing forth on the soundtrack.) Mr. Pollan, who periodically appears on screen seated at a homey-looking table, is a great strength of “Food, Inc.,” as is one of its co-producers, Eric Schlosser, the author of “Fast Food Nation.” These two embodiments of conscience, together with Mr. Kenner, chart how and why the villains not only outnumber the heroes in contemporary food production, but also how and why they outbluff, outmuscle and outspend their opponents by billions of often government-subsidized dollars.
If you’ve read either “Fast Food Nation” or “The Omnivore’s Dilemma,” you won’t be surprised by what the movie shows and tells about the killing floors and soybean fields. Chances are that you’ll still be appalled, which is to Mr. Kenner’s credit. Much as Mr. Schlosser does in “Fast Food Nation,” the movie takes a look at the animal abuse in industrial food production — including clandestine images of sick and crippled cows being prodded to join the rest of the ill-fated herd — but its main focus is on the human cost. It’s a cost visible in the rounded bodies of a poor family that eats cheap if filling fast-food burgers for breakfast and in the obscured faces of farmers too frightened to go on record about Monsanto, the agricultural biotech giant.
As Mr. Kenner marshals his prodigious evidence, including bushels of statistics, a veritable village of talking heads and too many dopey graphics, he makes the case that there’s something horribly wrong with a system in which a bag of chips cost less than a bag of carrots. It’s such a good case that you soon realize there are a dozen more documentaries tucked inside this one. The section on Monsanto is particularly eye-opening and could be spun out in more detail. And I could have spent more time with the philosophizing organic farmer Joel Salatin, who guts his chickens al fresco, hails his free-ranging livestock (“Hey, pig!”) and is a reality show waiting to happen. It could be called “Hello, and Goodbye, Pig!”
There is, in the end, something inherently frustrating about a movie that’s at once as fine, ambitious and, at a crisp 93 minutes, as abbreviated as “Food, Inc.” Time and again the movie stops short before it really gets started, as with the debates over the big business of organic food. The moment when an organic farmer cheerily tells a smiling Wal-Mart representative that her family has been boycotting the company for years is hilarious. But it’s also over before the issues have really been thrashed through. And while I appreciate the impulse behind the final checklist that tells what viewers can do for themselves and the world (er, eat organic), given everything we’ve just seen, it also registers as far too depressingly little.

The Growing Underclass: Jobs Gone Forever

Last night, President Obama talked about the need to put people back to work, calling job growth the “No. 1 focus in 2010.”
But one major obstacle to that goal — and one that has so far gone mostly unacknowledged — is that many of the jobs slashed during this recession are not coming back.
Lots of the bloodletting we’ve seen in the labor market has probably been permanent, not just cyclical. Many employers have taken Rahm Emanuel’s famed advice — never waste a crisis — to heart, and have used this recession as an excuse to make layoffs that they would have eventually done anyway. Some economists refer to this as the “cleansing effect” of recessions.
As a recent Congressional Budget Office report put it, “Recessions often accelerate the demise or shrinkage of less efficient and less profitable firms, especially those in declining industries and sectors.”
Think glassmaking. Or clerical work. Or, for that matter, newspapers.
Over all, the share of unemployed workers whose previous job has been permanently lost tends to rise during recessions, and the share of the unemployed who are just on temporary layoff falls. You can see both trends in the chart below.

In this recession, though, the shift from temporary layoffs to permanent job loss has been especially pronounced. In fact, the share of the unemployed who lost their jobs permanently is at its highest level since at least 1967, the first year for which the Labor Department has these numbers available.
Here’s another way to look at these trends, by what share of the unemployed are represented by each of the five categories of unemployed workers (that is, people who don’t have jobs yet because they’re new entrants to the labor market; re-entrants to the labor market; people who left their jobs; people who are on temporary layoff; and people who lost their jobs permanently).

The big ocean of blue represents the portion of the unemployed who have lost their jobs, with the lighter blue section showing those whose jobs are gone permanently.
There are multiple ways to explain why permanent job-losers represent a higher share of the unemployed this time around. Maybe, as others have suggested, many of the jobs gained in the boom years were built on phantom wealth. Or maybe the culprit is a corollary of Moore’s Law, the idea of exponential advances in technology over time. That might suggest that innovation and automation displace more and more workers by the time each recession rolls around.
Whatever the underlying cause, the result is disconcerting: compared with previous recessions, many more of the employment gains in this recovery will have to come from new jobs.
That is much easier said than done.
Workers whose entire occupations — not just the previous payroll positions they held — are disappearing (think: auto workers) will need to start over and find a new career path. But the new skills they will need take a long time to acquire.
What’s more, in addition to obtaining new degrees or training, some workers may need to move to new places in order to start a different career. But sharp declines in housing prices, plus high loan-to-value ratios on many mortgages before the downturn, will make that transition harder. Homeowners who are “underwater” — that is, who owe more in mortgage payments than their house is actually worth — may not be able to sell their house for enough money to enable them to buy a home in a new area.
All of which is to say that many of the Americans who are already out of work are likely to stay in that miserable state for a long, long time. And the longer they stay unemployed, the harder it will be for them to transition back into the work force, further adding to America’s growing underclass.
The administration is likely to have a big labor (and class) problem on its hands, and one that won’t be solved merely by an increase in the gross domestic product.

What A Jobs-Focused State-of-the-Union Address Ought To Say About Immigration

What Pres. Obama says -- or doesn't say -- about immigration will be the easiest tip-off to whether his first priority truly is putting Americans back to work. Or whether his talk about jobs is mainly a political ploy to gain back support from Independent voters. Here is what he should say (be sure to send this fax to President Obama with State of the Union suggestions) . . .

No. 1: Urge Congress to pass the SAVE Act in the next 30 days

Thus far, federal spending to put (or keep) nearly 1 million Americans in jobs has cost between $200,000 and $350,000 per job. (See my earlier blogs on Stimulus jobs vs. opening up jobs held by illegal foreign workers.)

But the SAVE Act could put up to 7 million jobless Americans back to work for a cost of no more than a few hundred dollars per job, and probably for less than $100!

The majority of the 23 million U-6 unemployed Americans lack a college degree and are looking for jobs in construction, service, manufacturing and transportation. Those are exactly the jobs currently being held by an estimated 7 million illegal aliens (not counting those working in agriculture).

Every principle of justice calls for those jobs to be transferred to 7 million unemployed Americans.

The vehicle to make that happen already exists and has more than 100 bi-partisan co-sponsors in Congress. The SAVE Act (H.R. 3308 and S. 1505) is even sponsored from within the President's own Party by Rep. Shuler (D-N.C.) and Sen. Pryor (D-Ark.).

The Save Act would immediately begin phasing in mandatory use of E-Verify for every employer in America. It also would institute a key provision that would identify multiple uses of the same Social Security number, driving out illegal aliens who have used fraudulent and stolen IDs to get a job.

This should be easy for Pres. Obama who believes in the E-Verify system so much that he implemented an executive order last summer that requires every federal contractor to use it to keep illegal aliens out of their jobs.

No. 2: Suspend the visa lottery and chain migration of extended families.

The President should also call on Congress to quickly pass H.R. 878 of Rep. Gingrey (R-Ga.) to end chain migration and H.R. 2305 of Rep. Goodlatte (R-Va.) to end the lottery.

If the President isn't willing to permanently end those categories for unnecessary foreign workers, then he should work with congressional leaders to move a bill that would temporarily suspend these categories at least until U-6 unemployment falls below 10% and U-3 unemployment falls below 6%.

There can be no excuse for raffling off 50,000 permanent work permits each year while Americans are suffering catastrophic unemployment.

Nor can there be justification for bringing in more than 200,000 permanent foreign workers each year just because they have relatives already here. Understand that chain migration relatives are not spouses or minor children. Rather, they are adults who have their own lives and families back in the home country. When given a Green Card, each of the chain migrants can bring their own nuclear family, and then their spouses can bring in all their siblings and families, so that aunts, uncles, cousins and in-laws multiplied by in-laws eventually get in line.

The chain immigrants are brought into the country with no consideration of their education, their skills or whether the workplace has any need of them. The fact is that they all immediately become competitors with 23 million jobless Americans in seeking the next job that opens up.

No. 3: Stop issuing work permits in any employment category until jobs have been posted on a nationwide help-wanted website.

All immigration categories combined are adding approximately 75,000 permanent foreign workers to our workforce every month (a total of 125,000 new foreign workers a month get either a permanent or temporary work permit).

No President whose top concern is putting his unemployed fellow citizens back to work would allow this to continue. Pres. Obama may find it difficult to bring these numbers to zero, but he should try to move the number as low as possible.

It is incredible that businesses across America have continued to insist on foreign workers instead of taking a look at the suffering U.S. workers begging for jobs just outside their hiring gates. But that is what has happened, and the Bush and Obama Administration have done everything possible to help the businesses avoid hiring U.S. workers.

This has to stop.

At the very least, Pres. Obama should require that every business applying for a visa for a foreign worker post the job on a central help-wanted website so that all unemployed Americans have first crack at the jobs. And the website should provide a full record of how many Americans a business turns down if it still insists on hiring a foreign worker.

If the President doesn't feel he can do this on his own, he should ask for immediate permissive legislation from Congress.

No. 4: Motivate Congress with this terrifying scenario . . .

The President should look out over the sea of 535 Members of Congress and ask them to imagine going back home to a single Congressional District and holding a rally in the biggest stadium or convention center in the District.

Each Congressional District on average has just over 50,000 U-6 unemployed workers.

Imagine gathering all the U-6 unemployed workers of that District. (The average District has 50,000 of them!)

Imagine standing in front of the 50,000 unemployed workers who are failing to find a full-time job and explaining to them why you want to continue to allow 7 million illegal aliens to keep their jobs, why you want to continue to allow chain migration and the lottery to bring in more people to compete with them for their job search, why you intend to do nothing about the handing out of 125,000 work permits to new foreign workers every month.

The President should tell the Members of Congress that if they aren't willing to gather their unemployed voters, look them in the eye and explain why illegal aliens and new foreign workers have precedence over the 50,000 unemployed in every District, then they should back the three big measures outlined above to put millions of Americans back to work.

All of that is what a President would do if putting Americans back to work were his real top priority and not just political rhetoric.

Amnesty legislation will kill jobs

Over the past year, the administration and Congressional Democrats have touted their No. 1 priority as “jobs, jobs, jobs;” however, their actions over the past year have proved otherwise.

As the economy tanked and the number of unemployed soared, the White House pushed a so-called stimulus loaded with money for pet projects and special interests, job-killing cap-and-trade legislation, and a Washington takeover of the health care system.

While the economy has by no means recovered, Congressional Democrats have once again displayed the breadth of their misplaced priorities by introducing mass amnesty legislation in the House of Representatives. The legislation contains a potpourri of highly questionable provisions, but the most outrageous aspect of the bill is that it jeopardizes millions of jobs for Americans and legal residents.

Among its provisions, the legislation recently unveiled by House Democrats grants amnesty to the estimated 12 million illegal aliens currently residing in the United States, thereby protecting them from removal and allowing them to work and travel freely throughout our nation. With over 15 million Americans unemployed and an estimated 7 million illegals employed, granting amnesty to those that have recklessly disregarded our nation’s immigration laws is an affront to American citizens and legal residents.

In addition, the legislation severely weakens existing and proven worksite enforcement activities. The bill throws E-Verify in the trash, a commonsense program which checks workers’ names and Social Security numbers to confirm employment eligibility and enjoys a success rate of 99.6 percent, and reinvents the wheel with a new, yet extremely vague, employment verification system.

Furthermore, the bill increases mandates during immigration-related enforcement activities by requiring the presence of social service agencies, translators and legal services. As the Obama administration has already weakened and cut back on the number of worksite enforcement actions, this provision sends a message to illegals that they can keep coming to the United States and take jobs away from citizens and legal immigrants.

Rather than enacting a “comprehensive” plan that would put illegals on a path to citizenship, I believe that Congress must take an enforcement-first approach to solving our nation’s immigration and border security. To this end, my bill, the Loophole Elimination and Verification Enforcement Act, will stem the inflow of illegal aliens by securing our borders, denying access to American jobs and closing loopholes in our government programs that provide access to benefits.

With an enforcement strategy, the United States could reduce the illegal population by as many as 1.5 million each year, which would more than halve our current illegal alien population in five years, and create 7 million jobs for citizens and legal workers. By securing the border and ending the job magnet, illegals will lack incentives to cross the border and the illegal alien population will begin to dwindle.

All in all, the administration and Congressional Democrats need to get their priorities in order. Millions of Americans are hurting and the unemployment rate is the highest we’ve seen in decades. Let’s put the American people back to work rather than add more to the unemployment roles.

New Study Shows Negative Impacts of Illegal Immigration on America's Teens and Young Adults

A new study commissioned by the Chicago Urban League and the Alternative Schools Network reveals the negative impacts of illegal immigration on low-skilled American workers, specifically teens and young adults.

As a result of the study, the group is calling for $1.5 billion of economic stimulus money to help employ young Americans or get them re-enrolled in school. The study found that the unemployment rate among Illinois teens was 20 points below the 2000 level, setting an all-time high. But increased immigration enforcement to root out the estimated 7 million illegal aliens in the U.S. workforce would help free up jobs for America's lower skilled workers.

Ranking Member of the House Judiciary Committee Lamar Smith (R-Texas) and Rep. Gary Miller (R-Calif.), who introduced the LEAVE Act that would increase interior enforcement, released a statement about the study's findings.

During the course of the 2007-2009 recession, the employment rate of the nation’s teen[s] feel steeply to 26.2% by October-November 2009, setting new record lows each year. No other age group has experienced employment declines of this magnitude in the current recession. Young adults 20-24 years old in both Illinois and the nation also have been adversely affected by the deterioration in labor market developments in the state and nation in recent years, especially men, Blacks and Hispanics, and non-college graduates.

In their joint statement, Reps. Smith and Miller said that the jobs these Americans and legal immigrants seek are the same jobs held by illegal aliens.

“The fact is that illegal immigrants take jobs from American workers, particularly poor and disadvantaged citizens and legal immigrants. The best outcome for low-skilled citizen and legal immigrant workers is the removal of the illegal immigrant population. The very jobs that illegal immigrants occupy rightfully belong to out of work citizens and legal immigrants," Ranking Member Smith added. “With 15 million Americans out of work, we need to enforce immigration laws and oppose amnesty for 12 million illegal immigrants. We must stand up for citizens and legal immigrants.”

“At home in California, almost weekly I hear from my constituents that illegal immigration is exacerbating the unemployment crisis," Rep. Miller said. "Today’s report that a record number of young Americans are jobless once again highlights the fact that we must enforce our current immigration laws to ensure illegals do not take away jobs that rightfully belong to American and legal workers.”

Reps. Smith and Miller recently formed the Reclaim American Jobs Caucus.
