This paper focuses on the net fiscal effects of immigration with particular emphasis on the fiscal effects of low skill immigration. The fiscal effects of immigration are only one aspect of the impact of immigration. Immigration also has social, political, and economic effects. In particular, the economic effects of immigration have been heavily researched with differing results. These economic effects lie beyond the scope of this paper. Overall, immigration is a net fiscal positive to the government’s budget in the long run: the taxes immigrants pay exceed the costs of the services they receive. However, the fiscal impact of immigrants varies strongly according to immigrants’ education level. College-educated immigrants are likely to be strong contributors to the government’s finances, with their taxes exceeding the government’s costs. By contrast, immigrants with low education levels are likely to be a fiscal drain on other taxpayers. This is important because half of all adult illegal immigrants in the U.S. have less than a high school education. In addition, recent immigrants have high levels of out-of-wedlock childbearing, which increases welfare costs and poverty. An immigration plan proposed by Senators Mel Martinez (R-FL) and Chuck Hagel (R-NE) would provide amnesty to 9 to 10 million illegal immigrants and put them on a path to citizenship (THERE ARE PROBABLY NEARLY 40 MILLION ILLEGALS HERE NOW). Once these individuals become citizens, the net additional cost to the federal government of benefits for these individuals will be around $16 billion per year. Further, once an illegal immigrant becomes a citizen, he has the right to bring his parents to live in the U.S. The parents, in turn, may become citizens. The long-term cost of government benefits to the parents of 10 million recipients of amnesty could be $30 billion per year or more (CALIFORNIA PUTS OUT $20 BILLION A YEAR IN SOCIAL SERVICES OF ILLEGALS).

In the long run, the Hagel/Martinez bill, if enacted, would be the largest expansion of the welfare state in 35 years.


Immigration and Crime Historically, immigrant populations have had lower crime rates than native-born populations. For example, in 1991, the overall crime and incarceration rate for non-citizens was slightly lower than for citizens.[40] On the other hand, the crime rate among Hispanics in the U.S. is high. Age-specific incarceration rates (prisoners per 100,000 residents in the same age group in the general population) among Hispanics in federal and state prisons are two to two-and-a-half times higher than among non-Hispanic whites.[41] Relatively little of this difference appears to be due to immigration violations.[42] Illegal immigrants are overwhelmingly Hispanic. It is possible that, over time, Hispanic immigrants and their children may assimilate the higher crime rates that characterize the low-income Hispanic population in the U.S. as a whole.[43] If this were to occur, then policies that would give illegal immigrants permanent residence through amnesty, as well as policies which would permit a continuing influx of hundreds of thousands of illegal immigrants each year, would increase crime in the long term.

The Fiscal Impact of Immigration One important question is the fiscal impact of immigration (both legal and illegal). Policymakers must ensure that the interaction of welfare and immigration policy does not expand the welfare-dependent population, which would hinder rather than help immigrants and impose large costs on American society. This means that immigrants should be net contributors to government: the taxes they pay should exceed the cost of the benefits they receive. In calculating the fiscal impact of an individual or family, it is necessary to distinguish between public goods and private goods. Public goods do not require additional spending to accommodate new residents.[44] The clearest examples of government public goods are national defense and medical and scientific research. The entry of millions of immigrants will not raise costs or diminish the value of these public goods to the general population. Other government services are private goods; use of these by one person precludes or limits use by another. Government private goods include direct personal benefits such as welfare, Social Security benefits, Medicare, and education. Other government private goods are “congestible” goods.[45] These are services that must be expanded in proportion to the population. Government congestible goods include police and fire protection, roads and sewers, parks, libraries, and courts. If these services do not expand as the population expands, there will be a decrease in the quality of service. An individual makes a positive fiscal contribution when his total taxes paid exceed the direct benefits and congestible goods received by himself and his family.[46] The Cost of Amnesty Federal and state governments currently spend over $500 billion per year on means-tested welfare benefits.[57] Illegal aliens are ineligible for most federal welfare benefits but can receive some assistance through programs such as Medicaid, In addition, native-born children of illegal immigrant parents are citizens and are eligible for all relevant federal welfare benefits. Granting amnesty to illegal aliens would have two opposing fiscal effects. On the one hand, it may raise wages and taxes paid by broadening the labor market individuals compete in; it would also increase tax compliance and tax receipts as more work would be performed “on the books,”[58] On the other hand, amnesty would greatly increase the receipt of welfare, government benefits, and social services. Because illegal immigrant households tend to be low-skill and low-wage, the cost to government could be considerable. The Center for Immigration Studies (CIS) has performed a thorough study of the federal fiscal impacts of amnesty.[59] This study found that illegal immigrant households have low education levels and low wages and currently pay little in taxes. Illegal immigrant households also receive lower levels of federal government benefits. Nonetheless, the study also found that, on average, illegal immigrant families received more in federal benefits than they paid in taxes.[60] Granting amnesty would render illegal immigrants eligible for federal benefit programs. The CIS study estimated the additional taxes that would be paid and the additional government costs that would occur as a result of amnesty. It assumed that welfare utilization and tax payment among current illegal immigrants would rise to equal the levels among legally-admitted immigrants of similar national, educational, and demographic backgrounds. If all illegal immigrants were granted amnesty, federal tax payments would increase by some $3,000 per household, but federal benefits and social services would increase by $8,000 per household. Total federal welfare benefits would reach around $9,500 per household, or $35 billion per year total. The study estimates that the net cost to the federal government of granting amnesty to some 3.8 million illegal alien households would be around $5,000 per household, for a total federal fiscal cost of $19 billion per year.[61] Granting Amnesty is Likely to Further Increase Illegal Immigration The Immigration Reform and Control Act (IRCA) of 1986 granted amnesty to 2.7 million illegal aliens. The primary purpose of the act was to decrease the number of illegal immigrants by limiting their inflow and by legalizing the status of illegal immigrants already here.[63] In fact, the act did nothing to stem the tide of illegal entry. The number of illegal aliens entering the country increased five fold from around 140,000 per year in the 1980s to 700,000 per year today. Illegal entries increased dramatically shortly after IRCA went into effect. It seems plausible that the prospect of future amnesty and citizenship served as a magnet to draw even more illegal immigrants into the country. After all, if the nation granted amnesty once why wouldn’t it do so again? The Hagel/Martinez legislation would repeat IRCA on a much larger scale. This time, nine to ten million illegal immigrants would be granted amnesty. As with IRCA, the bill promises to reduce future illegal entry but contains little policy that would actually accomplish this. The granting of amnesty to 10 million illegal immigrants is likely to serve as a magnet pulling even greater numbers of aliens into the country in the future. If enacted, the legislation would spur further increases in the future flow of low-skill migrants. This in turn would increase poverty in America, enlarge the welfare state, and increase social and political tensions. ..................................................

California counties cut healthcare to illegal immigrants
With budget problems afflicting counties across the state, some have begun eliminating healthcare to illegal immigrants. Critics say this will only shift the burden to hospital emergency rooms.

Forced to slash their budgets, some California counties are eliminating nonemergency health services for illegal immigrants -- a move that officials acknowledge could backfire by shifting the financial burden to emergency rooms.

Sacramento County voted in February to bar illegal immigrants from county clinics at an estimated savings of $2.4 million. Contra Costa County followed last month by cutting off undocumented adults, to save approximately $6 million. And Yolo County is voting on a similar change next month, which would reduce costs by $1.2 million.

"This is a way for us to get through what I think is a horrible year for healthcare in California," said William Walker, director of Contra Costa Health Services.

Walker said the national ambivalence on immigration policy means that illegal immigrants are living here but without federal or state funding to provide essential medical services to them. Walker, who began his medical career treating undocumented farmworkers, said that deciding to cut their services was difficult.

"This is the community of people we have all relied upon for decades, providing work not only in construction but in service and child care," he said. "We all live and work here together."

Trend could spread

As the recession continues, property tax revenue decreases and the number of newly uninsured patients increases, other county health departments in California and the nation may make similar changes, said Robert Pestronk, executive director of the National Assn. of County and City Health Officials.

"Communities are having to make excruciating decisions about the services they fund," he said.

But Pestronk said that shifting costs isn't the answer.

"This is a balloon that just expands," he said. "If you squeeze it in one place, it's just going to expand somewhere else."

John Schunhoff, Los Angeles County's interim health services department director, said there is no plan to eliminate health services to the county's illegal residents, despite significant projected deficits and concern about further cuts in state funding.

Eliminating illegal immigrants from health services may enable counties to balance their budgets this year but won't solve the problem in the long term, said David Hayes-Bautista, professor of medicine and director of UCLA's Center for the Study of Latino Health and Culture.

"We are mortgaging the future to scrape through the present," he said.

And study after study shows that illegal immigrants are less likely than U.S.-born residents to go to the doctor or seek regular medical care, he said.

Anti-illegal immigration activist Barbara Coe said she was thrilled that counties are beginning to restrict services. Coe's group, California Coalition for Immigration Reform, sponsored Proposition 187, the initiative that tried to bar the state from providing public services to illegal immigrants before it died in federal court.

Illegal immigrants "have absolutely no right, No. 1, to be here and, No. 2, to take the tax dollars of law-abiding American taxpayers for anything," she said.

But the policy changes have angered immigrant rights advocates, who argue that restrictions could also cause a chilling effect on legal residents and U.S. citizens in mixed-status families.

"Even those people who qualify to get care won't," said Reshma Shamasunder, director of the California Immigrant Policy Center.

Shamasunder also said that denying healthcare to one segment of the population puts everyone else at risk as communicable diseases go untreated and emergency rooms become even more crowded.

Jose Suarez, who has asthma, said he now plans to go to the hospital if he gets sick. Suarez, 25, was born in Mexico but has been living in Contra Costa County for 10 years.

"It's unfair," he said. "We are real people. I understand they have to cut a few things here and there, but I believe they can do better."

Few options

Marina Espinoza, also an illegal immigrant in Contra Costa County, said she visits a county clinic a few times a month to monitor her diabetes and high blood pressure so that she doesn't end up in the hospital. Espinoza is considering returning to Mexico, where a relative has a lead on a job with health insurance.

"None of us choose to get sick," said Espinoza, 39. "I can't afford the medications. How can I pay for that? It's that or rent."

Before changing its policy on illegal immigrants, Sacramento County took several other steps to reduce healthcare costs, including closing three of its six clinics. But that wasn't enough, said Keith Andrews, chief of primary health services in the Department of Health and Human Services. Andrews said he was left with a choice between firing staff or reducing the number of patients. The county is continuing to treat everyone for communicable diseases.

Andrews said about 4,000 people without legal residency or citizenship were receiving healthcare in the county. Although some are immigrants who have lived and worked in the area for years, he said, others are foreign natives who came to the county to receive free medical treatment.

"This decision is going to impact all of our community," he said. "It's going to create other social problems because of the impact on emergency rooms."

Seeking solutions

In Contra Costa County, which will continue treating undocumented children and pregnant women, community groups mobilized against the proposal. They helped persuade county officials to allocate additional funds to the nonprofit community clinics to help treat the 5,500 undocumented patients who will no longer be eligible for county services.

Those patients will receive primary care at the clinics, but they won't have a place to go if they need to see a specialist, such as for cancer or heart problems.

"It's a major gap," said Soren Tjernell of the Community Clinic Consortium, which represents clinics in Contra Costa and Solano counties.

Yolo County's proposal, which goes before its Board of Supervisors on May 5, would affect about 1,200 undocumented patients. Joseph Iser, who heads the county health department, said he wished that he had another source of revenue to continue services for illegal immigrants.

"Except by helping us balance the budget, it doesn't help us, it doesn't help our citizens, it doesn't help our undocumented," he said. "But if we don't have the money, we just can't afford it."

Immigration bill sticker shock $127 BILLION (dated)
A government study puts the cost of the Senate's version of reform at $127 billion over 10 years.

The price tag for comprehensive immigration reform was not a key issue when the Senate passed its bill last May. But it is now.
One reason: It took the Congressional Budget Office (CBO) - the gold standard for determining what a bill will cost - until last week to estimate that federal spending for this vast and complex bill would hit $127 billion over the next 10 years.
At the same time, federal revenues would drop by about $79 billion, according to the CBO and the Joint Committee on Taxation. If lawmakers fix a tax glitch, that loss would be cut in half, they add.
In field hearings across the nation this month, House GOP leaders are zeroing in on the costs of the Senate bill. It's a bid to define the issue heading into fall elections and muster support for the House bill, which focuses on border security. They say that the more people know about the Senate version, including a path to citizenship for some 11 million people now in the country illegally, the less they will be inclined to support it.

"We are now just beginning to see a glimpse of the staggering burden on American taxpayers the Reid-Kennedy immigration legislation contains," said House Judiciary Committee Chairman James Sensenbrenner, who convened a field hearing at the State House in Concord, N.H., Thursday on the costs of the Senate bill.
But business groups and others backing the Senate bill say that the cost to the US economy of not resolving the status of illegal immigrants and expanding guest-worker programs is higher still. "In my opinion, the fairer question is: How will illegal immigrants impact the costs of healthcare, local education, and social services without passage of comprehensive immigration reform?" said John Young, co-chairman of the Agriculture Coalition for Immigration Reform, at Thursday's hearing.
"Had we solved this problem in a truly comprehensive way in 1986 ... we would not have the daily news reporting outright shortages of farm labor threatening the very existence of agricultural industries coast to coast," he adds.
Experts are poring over the new CBO data - and coming up with radically different assessments of the social costs of reform, ranging from tens of billions of dollars higher to a net wash.
On the issue of border security - a feature in both bills - there is little disagreement. The CBO estimates that the cost of hardening US borders in the Senate bill is $78.3 billion over 10 years, or about 62 percent of the bill's total cost.
The fireworks involve new entitlement spending in the Senate version. The CBO sets the price tag for services for some 16 million new citizens and guest workers at $48.4 billion through fiscal year 2016. That includes $24.5 billion for earned income and child tax credits, $11.7 billion for Medicaid, $5.2 billion for Social Security, $3.7 billion for Medicare, and $2.4 billion for food stamps.
But it's easier to estimate the cost of a mile of fence than to assess the prospects for millions of workers, once they can work legally and claim benefits.

US home repossessions set record in April, foreclosures plateau at “very high level”

Banks in the US repossessed 92,400 homes in April, a record number and 45 percent higher than in April 2009. At the present rate, with more than 350,000 houses taken over by lenders in the first four months of 2010, more than 1 million American homes will be repossessed this year. In 2009, 918,000 repossessions took place, a 6.5 increase over the previous year. Behind these dry figures lie social dislocation and misery for millions.
One in every 45 US households was affected by at least one foreclosure filing (default notice, scheduled auction or bank repossession) last year, almost four times higher than the 2006 rate.
Driving the ongoing housing crisis are chronically high levels of unemployment. With nearly 27 million people jobless or underemployed, and wages stagnating or declining, there is no reason to expect the foreclosure and repossession epidemic to subside.
According to RealtyTrac, the total number of foreclosure filings in April declined by 9 percent over March, to 333,800, down 2 percent from April 2009. Nonetheless, April marked the 14th consecutive month with more than 300,000 foreclosure filings.
Nevada’s foreclosure rate ranked highest in the nation for the 40th straight month; 1 in every 69 housing units in the state received a foreclosure filing in April, five times the national average. In Arizona, which had the second worst rate, 1 in 169 housing units received a notice, while in Florida and California 1 in every 182 and 1 in every 192 properties, respectively, received a foreclosure filing. The rest of the top 10` were Idaho, Michigan, Illinois, Georgia and Colorado.
More than 19,000 Michigan properties received foreclosure filings in April, up 77 percent from April 2009.
Following the release of the figures, RealtyTrac CEO James Saccacio suggested that foreclosure activity “had begun to plateau, but at a very high level that will not drop off in the near future.”
Another company official, by implication, punctured the notion that the decline in default notices meant a material improvement in the housing situation. In an e-mail to the media, RealtyTrac executive vice president Rick Sharga commented, “Right now it appears that the banks are focusing on processing the loans already in foreclosure, and slowing down the initiation of new foreclosure proceedings as a way of managing inventory levels. We’ll probably see this trend continue for a while.”
Sharga suggested that 5 million delinquent home loans will probably end up in the foreclosure process, in addition to the 1.2 million homes already taken back by lenders. “The underlying conditions—mostly unemployment and millions of ‘underwater’ loans—haven’t improved,” he said.
Nearly one in four mortgages in the US is calculated to be “underwater”—i.e., the homeowner owes more than the house is worth. Zillow.com in Seattle estimates that the percentage climbed to 23 percent in the first quarter of 2010, up from 21 percent at the end of 2009, while CoreLogic, a financial data provider, puts the figure around 25 percent already. According to the latter firm, writes CNNMoney.com, “The total of negative equity in these deeply underwater borrowers is a whopping $655 billion.”
Increasing numbers of US homeowners are simply “walking away” from their houses, “because their value has dropped so precipitously,” notes CNNMoney. “These ‘strategic defaults’ now account for nearly one in three foreclosures,” according to a recent report from the University of Chicago. “Some homeowners walk away…because they realize that they will never recoup the losses.”
The federal government’s tax credit for first-time homebuyers expired April 30. Peter G. Miller, on the RealtyTrac website, writes, “The result is that a housing market that had begun to stabilize will now be set back as demand wanes, meaning that prices will soften.” (“Are We Headed For A New Real Estate Decline?”) A commentator on the Boston Globe website points out that a top Bank of America executive told a recent conference that the bank is “projecting a 600 percent increased in foreclosures by year end,” from 7,500 a month to 45,000 by December.
Handling foreclosures and repossessions has itself become a major (and lucrative) industry. RealtyTrac points to the following trend: “There are so many repo properties that lenders are hosting mass auctions nearly every weekend in California, Florida, Michigan, Nevada, Arizona and other states, where banks are cutting their losses from millions of dollars of bad debt. In fact repossessed bank-owned properties are so popular now that realtors nationwide are hosting repo home tours, filling small buses with repo buyers and taking them to foreclosed homes.”
The staggering number of foreclosures and repossessions is intimately linked to the impact of the recession, the most severe economic crisis since the 1930s. Jay Brinkmann, chief economist of the Mortgage Bankers Association, pointed to the obvious in a recent statement, “The pattern of mortgage delinquencies now very much follows the pattern of unemployment.… Just as long-term delinquencies now dominate total mortgage delinquencies, long-term unemployment now dominates the total unemployment number.… Until the issue of this large segment of long-term unemployed is resolved, many of the longer-term mortgage delinquencies will remain a problem with a strong likelihood of turning into foreclosures.”
The Obama administration’s housing policy, which alternates between a state of obvious indifference and various public relations stunts, is guided by a single principle: the vast profits of the banks and other lenders must not be impinged upon. This makes seriously assisting the millions in need of relief from the predatory financial institutions an impossibility.
An article on the Reuters website in January (“U.S. 2009 foreclosures shatter record despite aid”) pointed out, “State, federal and private efforts to modify loan terms for at-risk borrowers either don’t go far enough or are expanding too late to help many struggling homeowners on a permanent basis, many industry experts and economists agree.
“ ‘Until the lenders start to get into principal balance reduction you’re going to continue to see high redefault rates,’ Rick Sharga, senior vice president at RealtyTrac, said in an interview.
“ ‘We haven’t seen any appetite for that on the part of the lenders yet,’ he added.”
Indeed, “principal balance reduction” is the last thing on the minds of bankers and Obama administration officials alike.
In a report issued April 14, the Congressional Oversight Panel, the body assigned by Congress to oversee the bank bailout, takes the administration and its Treasury Department to task for its miserable response to the crisis.
After first noting that when the panel had last examined the housing situation in October 2009, “two years into the foreclosure crisis,” Obama’s “Home Affordable Modification Program” (HAMP) had “permanently modified the mortgages of only 1,711 homeowners,” the panel goes on: “Despite Treasury’s efforts, foreclosures have continued at a rapid pace. In total, 2.8 million homeowners received a foreclosure notice in 2009.…
“Treasury’s response continues to lag well behind the pace of the crisis. As of February 2010, only 168,708 homeowners have received final, five-year loan modifications—a small fraction of the 6 million borrowers who are presently 60+ days delinquent on their loans. For every borrower who avoided foreclosure through HAMP last year, another 10 families lost their homes. It now seems clear that Treasury’s programs, even when they are fully operational, will not reach the overwhelming majority of homeowners in trouble.”
The report points out that HAMP’s stated goal is to offer “loan modifications” to several million people, but that only some of these will result in even temporary modification, and only some will convert to “final, five-year status.” The panel writes: “Even among borrowers who receive five-year modifications, some will eventually fall behind on their payments and once again face foreclosure. In the final reckoning, the goal itself seems small in comparison to the magnitude of the problem.” The latter is an understatement.
The HAMP program only reduces payments, it does not reduce the total principal of a mortgage; therefore, the Congressional Oversight Panel observes, “many borrowers continue to experience severe financial strain,” paying on average 59 percent of their total income “on debt service, including payments on first and second mortgages, credit cards, car loans, student loans, and other obligations.” Furthermore, the HAMP modification does not reduce the total principal, “meaning that a borrower who was underwater before receiving a HAMP modification will likely remain underwater afterward.”
The panel points to “a precarious future” for most borrowers who proceed through Obama’s HAMP program. “Many will have no equity in their homes and are likely to question whether it makes sense to struggle so hard and for so long to make payments on homes that could remain below water for years. Many borrowers will eventually redefault and face foreclosure.… The redefaults signal the worst form of failure of the HAMP program: billions of taxpayer dollars will have been spent to delay rather than prevent foreclosures.” Bank profits, however, will have been protected.

Yet in cities where the crime these aliens commit is highest, the police cannot use the most obvious tool to apprehend them: their immigration status. Police officers know who they are and know that their mere presence in the country is a felony. The Arizona law has the salutary purpose of increasing the chance that any given illegal alien will be lawfully detected and deported, but the record suggests that a huge percentage of individuals apprehended under the law will simply illegally reenter.

This ICE press release boasts of success stories from the Secure Communities program, which under the Obama administration focuses on identifying and deporting only the most serious criminal aliens. It presents 26 cases in which violent or otherwise serious offenders were apprehended since late 2008; a full 13 of them had already been deported, many multiple times.

The record for reentry goes to a Mexican aggravated felon apprehended in Florence, Ariz., on May 22, 2009, who had been deported nine times, following 51 documented arrests under 16 different aliases. The runner-up is a Mexican arrested for assault causing bodily injury on June 9, 2009, in Starr County, Texas, who had been deported five times and was convicted of attempted murder in 2005. More typical is a Guatemalan drug dealer apprehended in Dallas on Aug. 7, 2009, who has been deported twice, and whose lengthy criminal history includes aggravated assault with a deadly weapon (legalese for shooting someone); a Honduran MS-13 gang member booked on March 8, 2009, in Boston, who had previously been removed once; and a Mexican gang member arrested for strong arm aggravated assault in Maricopa County, Ariz., who had been previously convicted of aggravated assault with a deadly weapon and deported once.

The logic of the Arizona law is that by increasing the chance of detection, it will discourage illegal aliens from entering in the first place and encourage those already in the country to leave on their own. Undoubtedly, many people will respond to the law as intended; the deterrent effect would be even greater if more states followed Arizona’s lead and discarded their actual or de facto sanctuary policies. But for other illegal aliens, the threat of detection and deportation is apparently not particularly meaningful. I don’t know whether the rate of illegal reentry (which is a felony) is higher for serious criminal aliens compared with illegal aliens who do not commit other crimes. But clearly, better interior enforcement, while a necessary part of restoring the immigration rule of law, cannot succeed in the absence of a truly secure border. The only reason for not creating a border fence that I can see is ambivalence about whether we really want to prevent illegal entry.

Audit looks at migrant re-arrests

WASHINGTON - Some illegal immigrants are being released from prison only to be arrested on new charges despite government efforts to deport them and keep them out of the country.

The findings are part of an audit by Justice Department Inspector General Glenn Fine that suggest authorities are still struggling to deport illegal immigrants who commit crimes, even though most state and local authorities are notifying immigration authorities of the imminent release of prisoners.

Fine's office analyzed the cases of 100 immigrants who had served time in prison and found 73 of them were rearrested after being released.

On average, each immigrant was rearrested six times, ranging from traffic violations to assault.

Fine's office couldn't determine how many illegal immigrants had been rearrested overall because immigration authorities don't keep track.

If the sample was any indication, "The rate at which released criminal aliens are rearrested is extremely high," the report said.

Last year, Homeland Security's inspector general said immigration authorities expected that most of the 300,000 illegal and legal immigrants eligible to be deported would be released.

Federal officials said they would need 34,000 additional beds at a cost of $1.1 billion to detain and remove all of them.

Illegal Aliens Abscond Under “Humane” ICE Program

Touted by the Obama Administration as key to overhauling the nation’s immigration detention system, a program that monitors illegal aliens instead of jailing them regularly loses track of offenders and the government distorts records to cover it up.
Operated by Immigration and Customs Enforcement (ICE), the intensive monitoring program allows illegal aliens to check in by phone, wear ankle monitors and obey a curfew rather than go to prison while they wait for court appearances. ICE claims the alternatives-to-detention program is a huge success and Obama assures it’s a great model for his plans to create a more humane immigration detention system.
But records and statistics obtained by a Houston newspaper under the Freedom of Information Act (FOIA) tell a much different story. Nearly one in five illegal immigrants who participated in the tracking project absconded while under supervision during the last five years, according to the records. Authorities were unable to locate nearly 20% of 6,373 illegal aliens enlisted in the program during that time. About 5% were subsequently rearrested for other matters.
ICE brags about a near perfect success rate because it simply erases those who absconded from the records as if they never existed. The Department of Homeland Security’s largest investigative agency, with about 20,000 employees and 400 offices worldwide, includes only active participants when it calculates its heavily altered statistics.
Based on the blatantly misleading data, Homeland Security Secretary Janet Napolitano is working to expand the alternatives-to-detention program, which currently has about 20,000 participants. The former Arizona governor, who has a documented history of opposing immigration enforcement, will submit a proposal to Congress before year’s end in hopes of accomplishing that goal.

Illegal Aliens Sue ICE Over Arrests

A group of illegal immigrants recently spared deportation by a sympathetic Connecticut judge are suing the federal agents that arrested them, claiming their constitutional rights were violated in the raids that led to their apprehension.
The illegal aliens, who live in New Haven, assert in a federal lawsuit that Immigration and Customs Enforcement (ICE) agents violated their rights during an early-morning fugitive operation in 2007 that led to the arrest of 30 people. Seventeen of them were subsequently charged with being in the U.S. illegally and a group of law students from a nearby Ivy League university represented them pro bono.
In August a federal judge (Michael Straus) in Connecticut blocked the deportation of four of the illegal aliens, ruling that their constitutional rights were “egregiously violated” because immigration agents entered their apartments without a warrant, probable cause or consent. Besides terminating removal proceedings, the judge suppressed any evidence gathered by federal agents because the illegal aliens’ constitutional protections to due process were violated.
Evidently emboldened by the ruling, the illegal immigrants are now suing the agents who conducted the raids, their supervisors and senior ICE officials. Weapons drawn, agents entered the illegal aliens’ homes without cause, consent or search warrants, according to the complaint filed this week. It further says that authorities had not previously determined that most of the arrested were in violation of immigration law and therefore had no reason to assume that they lacked legal status.
The lawsuit also declares that the feds deliberately conducted raids in New Haven to retaliate against the city for its well-known efforts to accommodate illegal immigrants. A few years ago New Haven became the nation’s first to offer illegal aliens official identification cards so that they can enjoy public services and integrate into the community. San Francisco followed its lead and began offering illegal immigrants ID cards this year.

The Justice findings by department Inspector General Glenn A. Fine examined the criminal histories of 100 illegal immigrants arrested and then released by local and state authorities in 2004, the latest complete data available. Of the sample group of 100, according to the audit, 73 immigrants were later arrested a collective 429 times - on charges ranging from traffic tickets to weapons and drug charges.

The data suggest "the rate at which released criminal aliens are re-arrested is extremely high," the audit noted. The report, parts of which were redacted, was required by Congress in 2005 and looked at how local and state authorities that receive Justice Department funding are working with the Homeland Security Department.

For years, the government was forced to release thousands of illegal immigrants who were caught in the United States because of not enough jail space and other resources. But last fall, with immigration as a key election-year priority, Homeland Security declared it would detain 99 percent of non-Mexican illegal immigrants until they could be returned to their home nations. The policy generally does not apply to Mexicans, who are almost immediately returned to Mexico after being stopped by Border Patrol agents.

The Justice audit, however, only looked at immigrants who were arrested and released by local and state authorities before they could be turned over to Homeland Security to be detained or deported. In all, 752 cities, counties and states participating in the program received $287 million in 2005, the audit noted.

Five states - California, New York, Texas, Florida and Arizona - received the bulk of the money, together pulling in more than $184 million.

Assistant Attorney General Regina B. Schofield, who oversees the Office of Justice Programs that controlled the funding, declined comment on the audit, noting that it does not contain any recommendations.

A separate report by the Transactional Records Access Clearinghouse at Syracuse University showed that the number of immigrants who were deported as "aggravated felons" doubled over the last 15 years, from 10,303 in 1992 to an estimated 23,065 in 2006.

But TRAC, which obtained the data from the Justice Department's Executive Office of Immigration Review, noted concerns that some of those immigrants never committed felonies.

"An individual can be declared an aggravated felon on the basis of a conviction on misdemeanor charges such as shoplifting," the TRAC report concluded.

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Just before the 2006 election, I predicted (among other things) that without the slim Republican majority in the House of Representatives, amnesty for illegal immigrants would soon become a reality. "If Democrats take control of the House," I wrote, "that barrier will vanish like mist, and the Democrats will have a flood of uneducated, largely ignorant new low-class workers to turn into good little Democrat voters, all demanding a piece of the government pie."Six months later, here comes the amnesty. Although the remaining Republicans managed to write increased border security measures into the bill, no one is naive enough to think they won't be simply ignored, just as they were in 1986. The "one-time" amnesty Ronald Reagan signed was also supposed to result in tighter border controls... which the Democrat-controlled Congress simply "forgot" to fund. So twenty-one years later, here we are again: facing another "one-time" amnesty, with promises of more border security we know will not be honored. This compromise will cut the 850-mile border fence the President signed into law just before the 2006 elections -- of which only two miles have yet been built -- to 370 or so miles. Anyone care to place bets on how much of even that shortened fence will ever exist in reality? With the Iranian terrorist group Hizballah building a massive base in South America from which to attack the US, how can we afford not to build that fence?The main point of the bill (much of which has not yet even been written) is to grant every single illegal alien currently in America a visa, allowing them to stay despite the fact that they broke the law to get here and violate numerous laws every day that they remain. I wonder when Congress will do the same for other categories of criminal. For instance, will car thieves be granted a "path to ownership" which allows them to keep their unlawfully-obtained vehicles? If so, I'm going to feel awfully stupid for saving up money to put down on a new car... the same way millions of people who are patiently waiting for permission to emigrate to the United States must feel as though they just received a boot to the face for respecting our laws. If lawbreakers are allowed to keep what they obtained by criminal means, then no matter what you may call it, it's an amnesty. Period.But we have to "bring millions of people out of the shadows," we are told by people such as Senator Ted Kennedy (D-MA). What shadows? Remember those huge illegal immigration rallies last year, in which hundreds of thousands of criminals -- along with their supporters and enablers -- marched through the streets of major US cities protesting the audacity of people who thought we should enforce our own laws? The only "shadows" I saw were cast by all the Mexican flags and "This is OUR continent, not YOURS" signs. There were other signs as well, but many of them were in Spanish, so I couldn't read them.This amnesty proposal will result in a huge influx of uneducated and unskilled immigrants over the next decade, too fast for our culture to absorb them. Food and services will increase in price, as the artificially-depressed wages paid under the table to those who had no choice but to accept them will have to rise. It will also bring in millions of new illegal immigrants, expecting yet another "one-time" amnesty a few years down the road. Many of these people will demand free medical care, welfare, and other government services. And which party will promise them all the freebies they could want? By agreeing to this compromise, the Republicans will doom their own party and marginalise Conservatives for years, ensuring a one-party Socialist state for at least a generation. Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

MULTICULTURALISM, IMMIGRATION AND AZTLAN

One of the standard arguments invoked by those in favor of massive immigration into the United States is that our country is founded on immigrants who have always been successfully assimilated into America's mainstream culture and society. As one commentator put it, "Assimilation evokes the misty past of Ellis Island, through which millions entered, eventually seeing their descendants become as American as George Washington."1 Nothing more vividly testifies against that romantic faith in America's ability to continuously assimilate new members than the events of October 16, 1994 in Los Angeles. On that day, 70,000 people marched beneath "a sea of Mexican flags" protesting Proposition 187, a referendum measure that would deny many state benefits to illegal immigrants and their children. Two weeks later, more protestors marched down the street, this time carrying an American flag upside down. Both protests point to a disturbing and rising phenomenon of Chicano separatism in the United States — the product of a complex of forces, among which are multiculturalism and a generous immigration policy combined with a lax border control. The Problem Chicanos refer to "people of Mexican descent in the United States" or "Mexican Americans in general." Today, there are reasons to believe that Chicanos as a group are unlike previous immigrants in that they are more likely to remain unassimilated and unintegrated, whether by choice or circumstance — resulting in the formation of a separate quasi-nation within the United States. More than that, there are Chicano political activists who intend to marry cultural separateness with territorial and political self-determination. The more moderate among them aspire to the cultural and political autonomy of "home rule". The radicals seek nothing less than secession from the United States whether to form their own sovereign state or to reunify with Mexico. Those who desire reunification with Mexico are irredentists who seek to reclaim Mexico's "lost" territories in the American Southwest.

Whatever their goals, what animates all of them is the dream of Aztlan. According to legend, Aztlan was the ancestral homeland of the Aztecs which they left in journeying southward to found Tenochtitlan, the center of their new civilization, which is today's Mexico City. Today, the "Nation of Aztlan" refers to the American southwestern states of California, Arizona, Texas, New Mexico, portions of Nevada, Utah, Colorado, which Chicano nationalists claim were stolen by the United States and must be reconquered (Reconquista) and reclaimed for Mexico. The myth of Aztlan was revived by Chicano political activists in the 1960s as a central symbol of Chicano nationalist ideology. In 1969, at the Chicano National Liberation Youth Conference in Denver, Rodolfo "Corky" Gonzales put forth a political document entitled El Plan de Aztlan (Spiritual Plan of Aztlan). The Plan is a clarion call to Mexican-Americans to form a separate Chicano nation: In the spirit of a new people that is conscious not only of its proud historial heritage, but also of the brutal "gringo" invasion of our territories, we, the Chicano inhabitants and civilizers of the nothern land of Aztlan from whence came our forefathers ...declare that the call of our blood is...our inevitable destiny.... Aztlan belongs to those who plant the seeds, water the fields, and gather the crops, and not to the foreign Europeans. We do not recognize capricious frontiers on the bronze continent.... Brotherhood unites us, and love for our brothers makes us a people whose time has come .... With our heart in our hands and our hands in the soil, we declare the independence of our mestizo nation. We are a bronze people with a bronze culture. Before the world, before all of North America, before all our brothers in the bronze continent, we are a nation, we are a union of free pueblos, we are Aztlan.

How Chicanos are Unlike Previous Immigrants Brent A. Nelson, writing in 1994, observed that in the 1980s America's Southwest had begun to be transformed into "a de facto nation" with its own culture, history, myth, geography, religion, education, and language. Whatever evidence there is indicates that Chicanos, as a group, are unlike previous waves of immigrants into the United States. In the first place, many Chicanos do not consider themselves immigrants at all because their people "have been here for 450 years" before the English, French, or Dutch. Before California and the Southwest were seized by the United States, they were the lands of Spain and Mexico. As late as 1780 the Spanish crown laid claim to territories from Florida to California, and on the far side of the Mississippi up to the Great Lakes and the Rockies. Mexico held title to much of Spanish possessions in the United States until the Treaty of Guadalupe Hidalgo ended the Mexican-American war in 1848. As a consequence, Mexicans "never accepted the borders drawn up by the 1848 treaty."

That history has created among Chicanos a feeling of resentment for being "a conquered people," made part of the United States against their will and by the force of arms. Their resentment is amply expressed by Voz Fronteriza, a Chicano student publication,
which referred to Border Patrol officers killed in the line of duty as "pigs (migra)" trying to defend "the false frontier."
Chicanos are also distinct from other immigrant groups because of the geographic proximity of their native country. Their physical proximity to Mexico gives Chicanos "the option of life in both Americas, in two places and in two cultures, something earlier immigrants never had." Geographic proximity and ease of transportation are augmented by the media. Radio and television keep the spoken language alive and current so that Spanish, unlike the native languages of previous immigrants into the United States, "shows no sign of fading."

A result of all that is the failure by Chicanos to be fully assimilated into the larger American society and culture. As Earl Shorris, author of Latinos: A Biography of the People, observed: "Latinos have been more resistant to the melting pot than any other group. Their entry en masse into the United States will test the limits of the American experiment...." The continuous influx of Mexican immigrants into the United States serve to continuously renew Chicano culture so that their sense of separateness will probably continue "far into the future...." There are other reasons for the failure of Chicano assimilation. Historically, a powerful force for assimilation was upward social mobility: Immigrants into the United States became assimilated as they rose in educational achievement and income. But today's post-industrial American economy, with its narrower paths to upward mobility, is making it more difficult for certain groups to improve their socioeconomic circumstances. Unionized factory jobs, which once provided a step up for the second generation of past waves of immigrants, have been disappearing for decades. Instead of the diamond-shaped economy of industrial America, the modern American economy is shaped like an hourglass. There is a good number of jobs for unskilled people at the bottom, a fair number of jobs for the highly educated at the top, but comparatively few jobs for those in the middle without a college education or special skills. To illustrate, a RAND Corporation study forecasts that 85 percent of California's new jobs will require post-secondary education. For a variety of reasons, the nationwide high-school dropout rate for Hispanics (the majority of whom are Chicano) is 30 percent — three times the rate for whites and twice the rate for blacks. Paradoxically, the dropout rate for Hispanics born in the United States is even higher than for young immigrants. Among Chicanos, high-school dropout rates actually rise between the second and third generations. Their low educational achievement accounts for why Chicanos as a group are poor despite being hardworking. In 1996, for the first time, Hispanic poverty rate began to exceed that of American blacks. In 1995, household income rose for every ethnic group except Hispanics, for whom it dropped 5 percent. Latinos now make up a quarter of the nation's poor people, and are more than three times as likely to be impoverished than whites. This decline in income has taken place despite high rates of labor-force participation by Latino men, and despite an emerging Latino middle class. In California, where Latinos now approach one-third of the population, their education levels are far lower than those of other immigrants, and they earn about half of what native-born Californians earn. This means that, for the first time in the history of American immigration, hard work is not leading to economic advancement because immigrants in service jobs face unrelenting labor-market pressure from more recently arrived immigrants who are eager to work for less. The narrowing of the pathways of upward mobility has implications for the children of recent Mexican immigrants. Their ascent into the middle-class mainstream will likely be blocked and they will join children of earlier black and Puerto Rican migrants as part of an expanded multiethnic underclass. Whereas first generation immigrants compare their circumstances to the Mexico that they left — and thereby feel immeasurably better off — their children and grandchildren will compare themelves to other U.S. groups. Given their lower educational achievement and income, that comparison will only lead to feelings of relative deprivation and resentment. They are unlikely to be content as maids, gardeners, or fruit pickers. Many young Latinos in the second and third generations see themselves as locked in irremediable conflict with white society, and are quick to deride successful Chicano students as "wannabes." For them, to study hard is to "act white" and exhibit group disloyalty. That attitude is part of the Chicano culture of resistance — a culture that actively resists assimilation into mainstream America. That culture is created, reinforced, and maintained by radical Chicano intellectuals, politicians, and the many Chicano Studies programs in U.S. colleges and universities. As examples, according to its editor, Elizabeth Martinez, the purpose of Five Hundred Years of Chicano History, a book used in over 300 schools throughout the West, is to "celebrate our resistance to being colonized and absorbed by racist empire builders." The book calls the INS and the Border Patrol "the Gestapo for Mexicans."
For Rodolfo Acuna, author of Occupied America: The Chicano's Struggle Toward Liberation, probably the most widely assigned text in U.S. Chicano Studies programs, the Anglo-American invasion of Mexico was "as vicious as that of Hitler's invasion of Poland and other Central European nations...." The book also includes a map showing "the Mexican republic" in 1822 reaching up into Kansas and Oklahoma, and including within it Utah, Nevada, and everything west and south of there.

At a MEChA conference in 1996, Acuna referred to Anglos as Nazis: "Right now you are in the Nazi United States of America." The effect of books such as those is to radicalize young Chicanos. As an example, although Chicano undergraduates at Berkeley lacked any sort of strong ethnic identity before entering college, in Berkeley they became "born again" as Chicanos because of MEChA and Chicano Studies departments. The strident rhetoric of intellectuals is echoed by some Mexican-American politicians. Former California state senator Art Torres called Proposition 187 "the last gasp of white America" and spoke of "reclaiming" Southern California. The Mexican government also contributes to the Chicano sense of separateness through its recent decision that migrants will not forfeit their Mexican citizenship by becoming U.S. citizens and are allowed to vote in Mexican elections. Multiculturalism and Immigration All of this is exacerbated by the U.S. government's immigration policy and a new ethic of multiculturalism that has become almost an official dogma in the mass media and in academe. Exponents of multiculturalism maintain that all cultures are equal, and that the United States must accept its destiny as a universal nation, a world nation, in which no one culture — especially European culture — will be dominant. "The ideal of multiculturalism is a nation which has no core culture, no ethnic core, no center other than a powerful state apparatus." The social ethic of multiculturalism is actively supported by an official government policy of "corporate pluralism" which militates against America's earlier ideal of assimilation. According to Gunnar Myrdal, "corporate pluralism" refers to a society where racial and ethnic entities are accorded formal recognition and standing by the state as groups in the national polity, and where political power and economic reward are based on a distributive formula that postulates group rights and defines group membership as an important factor in the outcome for individuals. By replacing individual meritocracy with group rewards, corporate pluralism "strongly discourages assimilation in the conventional sense because if a significant portion of one's rational interests are likely to be satisfied by emphasis on one's ethnicity, then one might as well stay within ethnic boundaries and at the same time enjoy the social comforts of being among people of one's own kind." Corporate pluralism is realized through such government policies as affirmative action, court-ordered busing, and bilingual education. In the case of the latter, by the late 1970s, bilingual education has become "a Hispanic institution." A bilingual establishment has been formed which "fights for jobs and perks" and is determined to maintain Spanish as both language and culture.* Being supported by government laws, that establishment cannot easily be dislodged.

Conclusion Chicanos are not the only ethnic groups in the United States who resist assimilation and are geographically concentrated in certain areas and cities. The Cubans in Miami and Chinese in Monterey Park are other examples, but neither group is large enough to practice autonomism or separatism. Chicanos in the Southwest, however, are great in numbers and "are producing spokesmen for...autonomism, separatism, and even irredentism." Since 1977, INS has apprehended over a million illegals a year, the majority Hispanics; anywhere from 2 to 5 million eluded the INS. By the early 1980s, the number of illegal aliens in the United States, mostly Hispanic, totalled 3 to 12 million. In 1980, the Census Bureau counted 14.6 million Hispanics in the United States, increasing to 15.8 million by 1982, and 17.3 million by 1985 — making America the 5th or 4th largest Spanish-speaking country in the world.27 According to the 1990 Census, Latin America accounted for 38 percent of America's foreign-born, well over half of whom were from Mexico. The real percentage is probably higher because illegal aliens avoid the census and most illegals are from Latin America. According to a report by the Urban Institute in 1984 entitled The Fourth Wave: California's Newest Immigrants, by the year 2000, 42 percent of Southern California's residents will be Caucasian, 41 percent Hispanic, 9 percent Asian and 8 percent black. Demographers Leon F. Bouvier and Cary B. Davis in Immigration and the Future Racial Composition of the United States expect that, by 2080, Hispanics (more than half Chicano) will constitute 34.1 percent of the total U.S. population, even if immigration were restricted to 2 million entrants a year from all areas of the world and birthrates of Hispanics converge with those of non-Hispanics. In 2080, Hispanics will be either a plurality or a majority of the population in California and Texas at 41.4 percent and 53.5 percent, respectively, assuming an influx of a conservative one million immigrants a year. Former Senator Eugene McCarthy, writing in 1987, had warned of a "recolonization". McCarthy's warning was sounded five years earlier by a historian of race relations, George Fredrickson. Speaking at a colloquium on race relations in 1982, Fredrickson observed that: There are two ways that you can gain territory from another group. One is by conquest. That's essentially the way we took California from Mexico and... Texas as well. But what's going on now may end up being a kind of recolonization of the Southwest, because the other way you can regain territory is by population infiltration and demographic dominance .... The United States will be faced with the problem that Canada has been faced with... and which our system is not prepared to accomodate. Mario Barrera, a faculty member of U.C. Berkeley's Department of Ethnic Studies, admitted that multiculturalism "would help prepare the ideological climate for an eventual campaign for ethnic regional autonomy." In January 1995, El Plan de Aztlan Conference at UC Riverside resolved that "We shall overcome...by the vote if possible and violence if necessary." The rise of Mexican irredentism as a serious political movement "awaits only the demographic transformation of the Southwest." As an article entitled "The Great Invasion: Mexico Recovers Its Own" in 1982's Excelsior, Mexico's leading daily newspaper, put it: The territory lost in the 19th century by...Mexico...seems to be restoring itself through a humble people who go on settling various zones that once were ours on the old maps. Land, under any concept of possession, ends up in the hands of those who deserve it.... [The result of this migration is to return the land] to the jurisdiction of Mexico without the firing of a single shot. Multiculturalism and United States government's immigration policy have contributed towards the rise of Chicano ethnic separatism within the American Southwest that has all the makings of an incipient Nation of Aztlan. Incidentally, I started this very quietly because there are those that if they knew that we were creating a whole new cadre of brand new citizens it would have tremendous political impact. We will change the political panorama not only of L.A., but L.A. County and the State. And we do that we've changed the panorama of the nation. I'm proud to stand here and tell you that in those close to three years we have processed a little over 78,000 brand new citizens. That is the largest citizenship program in the entire nation."
