Congressman Hunter Introduces Key Immigration Bills

Congressman Duncan D. Hunter (R-CA) introduced two key immigration bills this past month, the “Enforce the Law for Sanctuary Cities Act” (H.R. 1134) and the “Unlawful Border Entry Prevention Act of 2011” (H.R. 1091).

In an important step in keeping state and local governments from contravening federal immigration law, the “Enforce the Law for Sanctuary Cities Act” would amend Section 241(i) of the Immigration and Nationality Act (INA) to prohibit state and local governments with “sanctuary city” policies in place from receiving federal reimbursements for incarcerating illegal aliens. (§2) Under the bill, state and local governments would also be ineligible for SCAAP funds if they prohibit law enforcement officials from “gathering” information regarding the citizenship or immigration status of any individual. (Id.)

Intended to help secure the border, Rep. Hunter’s “Unlawful Border Entry Prevention Act of 2011” would grant the Department of Homeland Security (DHS) authority to construct reinforced fencing along not less than 350 miles of the southwest border. (§2(a)) Rep. Hunter’s bill is critical because under existing law, the Secure Fence Act of 2006, DHS has no legal authority to build additional infrastructure along the border. (See Public Law 109-367; Oct. 26, 2006) The bill would also require Homeland Security to submit to Congress a plan to gain “operational control” of a specific sector of the southwest border if the Department determines that there has been a 40 percent increase in apprehensions of illegal aliens crossing the border in that sector. (§3(a)) The bill defines “operational control” as the “prevention of all unlawful entries into the United States, including entries by terrorists, other unlawful aliens, instruments of terrorism, narcotics, and other contraband.” (§3(b)) The “Unlawful Border Entry Prevention Act of 2011” has bi-partisan support and is co-sponsored by both Republicans and Democrats including: Representatives Brian Bilbray (R-CA), Ted Poe (R-TX), Ed Royce (R-CA), Heath Shuler (D-NC), Tim Ryan (D-OH), and Mike McIntyre (D-NC).

“Despite considerable gains in recent years, the Southwest border is nowhere near secure,” said Rep. Hunter in a statement about his border entry prevention bill. (Rep. Duncan Hunter Press Release, Mar. 15, 2011) “Smuggling corridors remain wide open, providing direct access for drug runners, criminals and illegal immigrants . . . Thousands have died in Mexico due to border violence in the last two years alone,” he added. (Id.) Rep. Brian Bilbray, Chairman of the House Immigration Reform Caucus, also commented on the importance of the bill: “The United States must control our southern border to fight against illegal immigration and improving our national security. This cannot be accomplished unless the Department of Homeland Security has the legal authority to reinforce the border.” (Id.)

Personal life

Hunter was born in San Diego, California, and graduated from Granite Hills High School in El Cajon, California. He attended San Diego State University, where he earned a degree in Business Administration. Hunter started a web design company in college to help pay for tuition. Upon graduation from San Diego State, he worked full time in San Diego as an information technology business analyst.[3]

Hunter, his wife Margaret, and their three children have lived in Lakeside, California since 2007; he has previously lived in Oklahoma, Virginia and Idaho.[4][5]

The day after the September 11 attacks, Hunter quit his job and joined the Marine Corps. He attended Officer Candidates School at Marine Corps Base Quantico. Upon graduation in March 2002, was commissioned as a Second Lieutenant. He subsequently served as a field artillery officer in the 1st Marine Division after the 2003 invasion of Iraq and completed a second tour in Fallujah, Iraq, in 2004, serving in Battery A, 1st Battalion, 11th Marines. During his second tour, he participated in Operation Vigilant Resolve. In September 2005, Hunter was honorably discharged from active duty but remained in the Marine Corps Reserve. He then started a residential development company. In 2007, he was recalled to active duty and deployed to Afghanistan in support of the War in Afghanistan; this was his third tour of duty during the War on Terrorism. Hunter was honorably discharged from active duty in December 2007 but continues to serve part-time as a Captain in the Marine Corps Reserve.[6]

Hunter won the Congressional Republican primary election on June 3, 2008, after receiving 72 percent of the vote[7][dead link] and defeating three opponents. Combined with his name recognition, he went into the general election a strong favorite in his heavily Republican district.

On November 4, 2008, Hunter received 57 percent of the vote to defeat his Democratic opponent Mike Lumpkin.[8] Hunter thus replaced his father, Congressman Duncan L. Hunter (R-Calif.), who retired from Congress after fourteen terms.[9]

Like his father, Hunter's voting record has been decidedly conservative. In a 2009 interview with KPBS, Hunter expressed support for "overriding" the Endangered Species Act to reduce unemployment in California. Hunter also opposed the Health Care and Education Reconciliation Act of 2010, saying that it would "take away" the doctor-patient relationship, the right for people to choose "what type of operations they have," and that it would allow a "government bureaucrat" to make health care decisions for people. In the KPBS interview, Hunter said, "Things that you have problems with now would be exacerbated if you had government run healthcare."[5]

At an April 2010 Tea Party movement rally in Ramona, California, Hunter advocated for the deportation of United States citizens who are the children of illegal immigrants.[10] At the rally, Hunter said, "It's a complex issue and...you could look and say, 'You're a mean guy. That's a mean thing to do. That's not a humanitarian thing to do.' " Hunter added, "We simply cannot afford what we're doing right now. We just can't afford it. California's going under." Hunter confirmed the comments to San Diego County's North County Times, telling the newspaper that he also supported House Resolution 1868, a measure that called for the elimination of birthright citizenship in the United States. Hunter has also expressed support for the controversial 2010 Arizona immigration law, calling it a national security issue and "a fantastic starting point."[11][12]

Lee and Chaffetz Stand Strong against Utah Guest Worker Amnesty Bill

Two members of Utah’s delegation, U.S. Senator Mike Lee (R) and U.S. Congressman Jason Chaffetz (R) announced their opposition to Utah’s new guest worker amnesty law last week, declaring their belief that the law is unconstitutional. Under Utah’s new law, H.B. 116, the state may grant illegal aliens who enter the state before May 10, 2011 guest worker permits, allowing them to continue living and working in Utah—in direct violation of federal law. The bill also allows these illegal workers to sponsor their illegal alien relatives (spouses and children) for permits that allow them to accompany the worker. H.B. 116 will go into effect as soon as the State of Utah obtains a waiver from the federal government or July 1, 2013, whichever is sooner.

Rep. Chaffetz, a member of the House Judiciary Committee and the House Immigration Reform Caucus, denounced the bill at a recent town hall meeting. (Salt Lake Tribune, Mar. 22, 2011) “I feel it’s unconstitutional, and I took an oath to uphold the Constitution,” he said. (Id.) Chaffetz pointed out that by issuing guest worker permits, Utah has “come to the point that the state is trying to do something that clearly is the purview of the federal government.” (Id.) Sen. Lee, who sits on the Senate Judiciary Committee, made similar comments during an interview in his home state last week. “It’s just not going to happen,” he said. (Id.) “I know of no process in federal law that suggests that such a waiver could even be granted, nor do I know of any political inclination in Washington to let that happen….It would take a massive shift in federal law for [H.B. 116] to even be considered, and there’s no appetite to transfer that authority over to the states.” (Id.)

There is solid precedent for Chaffetz and Lee to argue Utah’s new law is unconstitutional. In 1976, the U.S. Supreme Court reaffirmed the federal government's exclusive authority to “regulate immigration.” (De Canas v. Bica, 424 U.S. 351, 354 (1976)) In doing so, the Court narrowly defined “regulation of immigration” as “essentially a determination of who should or should not be admitted into the country, and the conditions under which a legal entrant may remain.” (Id. at 355) Thus, by allowing the State of Utah to determine who receives guest worker permits and under which conditions a guest worker may remain, the Utah Legislature has usurped the federal government’s power to regulate who is admitted into the country and the conditions under which a person may stay.

But despite serious questions about the constitutionality of the law, Utah’s Attorney General, Mark Shurtleff, has been lobbying Department of Justice and White House officials to implement Utah’s new set of immigration laws—referred to as the “Utah Compact”—on a national scale. (Salt Lake Tribune, Mar. 9, 2011) Shurtleff presented the Compact to other state attorneys general at a national meeting earlier this month in Washington, D.C. (Id.) As part of his trip, Shurtleff also met with White House intergovernmental affairs staff as well as U.S. Attorney General Eric Holder. (Id.) “I think they were really impressed,” Shurtleff said in regards to his meetings. (Id.) “They didn’t commit to anything, but they were really excited about what Utah was able to accomplish.” (Id.)

Regardless of the Justice Department’s reaction, there is no process under federal law that would allow it to unilaterally invalidate the federal statutes that make it unlawful for illegal aliens to reside in the U.S. or for employers to hire illegal aliens. Thus, in granting Utah a waiver to implement its guest worker program, the Obama Administration would be affirmatively invalidating an act of Congress. However, if the Obama Administration refuses to grant Utah a waiver on the grounds that doing so would be unconstitutional, Utah’s guest worker bill will still go into effect on July 1, 2013. At that point, Americans will be watching to see if the Obama Justice Department sues the State of Utah as it sued the State of Arizona.

Eight Out of Ten Illegal Aliens Apprehended in 2010 Never Prosecuted, Says Border Congressman

Washington (CNSNews.com) – An illegal alien apprehended by the U.S. Customs and Border Protection agency during the last fiscal year had an estimated 84 percent chance of never being prosecuted, according to figures compiled by the office of Rep. John Culberson (R-Texas).

Culberson submitted the figures for the record during a hearing Wednesday of the House Appropriations subcommittee on homeland security.



Of 447,731 illegal aliens apprehended by the U.S. Border Patrol during fiscal year 2010 (which ended last September), only 73,263 (16.4 percent) were prosecuted, according to the submitted data. That means that 374,468 illegal aliens that were taken into custody (83.6 percent) were never prosecuted

SB 742 would give illegal aliens in Oregon in-state tuition, a $17,600 per year benefit. A $17,600 benefit that would be denied to an American citizens who went to high school in Idaho, Washington, California or any other state.



At a time when average Oregonians are forced to cut back, public schools are reducing staff and care for our disabled citizens, why is the Oregon Senate voting on a bill that would drive us further in debt?

The National Council of La Raza (NCLR) is not only one of the wealthiest and most politically powerful militant organizations in the country, it is also notoriously racist and subversive. The group's name, "La Raza," means "The Race," by which they are referring to ethnic Mexicans, or more broadly to "hispanics" or "latinos." And it is quite clear from their decades of vitriolic rhetoric — both spoken and written — that the La Raza activists are trying to engender not only race consciousness amongst hispanic U.S. citizens and Mexican migrants, but also racial militancy and animosity toward "Gringo America."

The NCLR grew out of the La Raza Unida (The Race United) Party and the Southwest Council of La Raza in the late 1960s and early 1970s. The key leaders were Marxist-Leninist followers of Fidel Castro and Che Guevarra.

The radical student group MEChA (Moviemento Estudiantil Chicano de Aztlan), with which NCLR has been closely allied for several decades, is even more explicitly and militantly, having adopted the slogan, "Por La Raza Todo, Fuera de La Raza Nada," which translated means: "For the Race, Everything; Outside the Race, Nothing."

MEChA's founding documents and literature are replete with appeals to "La Raza de Bronce" (The Bronze Race) and condemnation of the "brutal gringo." MEChA, as its name suggests, is also a leading promoter of the radical "reconquista" (reconquest) movement, a plan of to take over the states of California, Arizona, New Mexico, Colorado, and Texas — a region they refer to as "Aztlan" — which they claim was stolen from the "Aztecan" peoples. NCLR provides major financial support to MEChA and many of NCLR's leaders were MEChA leaders in their college days.

NCLR: Agents for the Government of Mexico?

Especially troubling is NCLR's leading role in the Fundacion Solidaridad Mexicano Americana (Foundation for Mexican-American Solidarity, FSMA), an organization founded and funded by the government of Mexico and directed by the Mexican Ministry of Foreign Affairs and Ministry of Public Education. Both of these ministries have been engaged in efforts aimed at demanding full political rights for illegal aliens in the U.S. and indoctrinating America's Hispanic population in radical, racist La Raza ideology.

Immigrant Job Numbers Grow as American Employment Declines

On Thursday of last week, the House Judiciary Committee's Immigration Subcommittee met to hear testimony on the effect of immigration on the American job market. The hearing, entitled "New Jobs in Recession and Recovery: Who Are Getting Them and Who Are Not," is especially relevant given that many Americans are still struggling to find work in the midst of our nation's weak economy.

At the hearing, Dr. Rakesh Kochar, Associate Director for Research at the Pew Hispanic Center, testified that in the year following the official end of the recession (June 2009), foreign-born workers gained 656,000 jobs while native-born workers lost an additional 1.2 million jobs. Foreign born workers, he said represent 15.7% of the total American workforce and that the immigrant share of the U.S. working-age population is rising. (See Pew, Hispanic Center, After the Great Recession: Foreign Born Gain Jobs; Native Born Lost Jobs, Oct. 29, 2010) As of last year, he said, at least 8 million unauthorized immigrants participated in the U.S. labor market. Economist Heidi Shierholz, from the Economic Policy Institute, testified that despite the fact that economists have declared an official end to the recession, there are still 5.4 percent fewer jobs available than when the recession began in 2007. Shierholz argued that the immigration system is completely unresponsive to the economic cycle. "For example, in 2010, the unemployment rate in construction was over 20 percent, but the Department of Labor nevertheless certified thousands of H-2B visas for construction workers. This defies logic," she said. Part of immigration reform, she concluded, would take into account the actual needs of the economy and its ability to accept additional workers.

Additional testimony came from Steven Camarota, Director of Research for the Center for Immigration Studies, and Greg Serbon, State Director of Indiana Federation for Immigration Reform and Enforcement (IFIRE). Camarota voiced concern that jobs created over the past decade are primarily going to foreign-born workers, while the number of working-age natives with jobs has fallen dramatically. Mr. Serbon spoke out about against the plethora of visa programs which allow non-immigrants to work in America and the prevalence of non-immigrant temporary visa holders overstaying the authorized visa time.

Chairman of the Judiciary Committee, Congressman Lamar Smith (R-TX), stated that there is no more important issue that the subcommittee can address above how to preserve jobs for American workers. And when it comes to finding solutions for the unemployed and underemployed Americans who are still struggling, the Chairman made clear that the "answer is not to keep adding to the supply of low-skilled workers during a severe recession and its aftermath."

House GOP votes to strip NPR of federal funding

WASHINGTON — The Republican-led House of Representatives voted Thursday to defund National Public Radio, an organization rocked by a series of embarrassments, most recently an undercover video that showed a fundraising executive disparaging conservatives and saying that the network could do without federal subsidies.

The 228-192 vote on the bill, which was brought to the floor on an emergency basis without hearings, was largely along party lines; all but seven Republicans voted "yes," while no Democrat voted for it.

The bill has little chance in the Democratic-controlled Senate.

The Republicans argued that the bill was needed to reduce federal spending, but the catalyst was clearly the surreptitious video, made by conservative activists posing as donors, of NPR's then-chief fundraiser running down the GOP and the tea party movement.

The uproar cost Vivian Schiller, NPR president and chief executive, her job, as well as the accelerated departure of the fundraiser, Ron Schiller. (They aren't related.) The network's firing in October of commentator Juan Williams also brought heat from conservatives.

"Let's be honest and talk about what this bill is about," said House Majority Leader Eric Cantor, R-Va. "This bill is about making sure that we are spending taxpayer dollars the way that the people that earn them would spend them. We saw ... on video, executives at NPR saying that they don't need taxpayer dollars."

The bill would prohibit federal funding to NPR and prevent NPR's member stations from using federal funds to purchase NPR programming, such as "Morning Edition" or other programs. The 414 affiliated stations get about 10 percent of their funds — $93 million in 2009 funding — through the federally funded Corporation for Public Broadcasting.

Patrick Butler, president of the Public Media Association, which represents public television stations and NPR, was critical of the House vote.

"The only result would be the loss of thousands of jobs in this industry, the closing or severe restriction of hundreds of local stations serving small-town and rural America which depend on federal funds for 30 (percent) to 100 percent of their annual budgets, including program acquisition, and the loss of vital information for millions of Americans," Butler said.

But lawmakers said the savings were necessary and would force NPR stations to develop their own programming.

"The only way to control our federal debt is to refocus our federal spending," said Rep. Joe Barton, R-Texas. "The funding for NPR was a nicety, not a necessity. This vote wasn't about ideology; it was about getting our fiscal house in order."

Democrats ridiculed the effort, which they said did not actually cut any funding, with Rep. Anthony Weiner of New York giving a stem-winding floor speech mocking Republicans for recognizing "the danger" from NPR "Car Talk" hosts — brothers Tom and Ray Magliozzi, known as Click and Clack — for their incomprehensible Boston accents.

"I am so relieved that we had this emergency session that we waived the rules of the House that requires 72 hours (notice) so we can get these guys off my radio," said Weiner, standing in front of a picture of the brothers." . . . The last thing we want is informative solutions to how we fix our cars."

The United States government is funding the National Council of La Raza with our tax dollars. La Raza, which literally means in Spanish “The Race,” is a radical organization that advocates open borders and amnesty for illegal aliens. I pulled and analyzed the tax return Form 990, the form filed by 501(c) 3 organizations to the IRS, and here is what was reported:

What do people get paid at La Raza?



According to the 2008 tax returns seventeen people listed as officers, directors, trustees, key employees and highest compensated employees of the National Council of La Raza have an income ranging from $119,675 to $378,446, the latter of which goes to Janet Murguia, president and CEO.



To put that income figure in perspective a rank and file United States Senator makes $174,000. A United States Marine Sergeant with five years of service earns a base salary of $29,376, including the raise received for 2011.



Lobbying:



Part II, Section 1b indicates lobbying expenditures to influence a legislative body amounted to $550,787.



Section 1g indicates lobbying expenditures to “Grassroots nontaxable amount” of $250,000.



Here is the quick analysis: The US government pays La Raza to lobby the US government for money.



The United States of America is facing a multitude of critical issues. Two of those issues are wasteful government spending and illegal immigration. Cutting funding for the National Council of La Raza would begin to help in both of those issues.

Karl Rove was one of the keynote speakers at this year's annual National Council of La Raza Conference. The event was held in Los Angeles (the eventual capital of Atzlan). The fact that Karl Rove is the President's top political adviser and addressed the group with Bush's blessing, is a strong indicator that this nation is being subverted at the very highest levels. If La Raza was a white supremacist group with equally deep pockets, the U.S. government would place them on a terrorist watch list, infiltrate them with undercover FBI agents, and subject them to constant harassment by the Internal Revenue Service. Eventually, the group's leaders would be jailed and the group itself would be rendered irrelevant. However, because La Raza is a Latino supremacist group, the Bush administration and most of Congress offer them financial support! One of La Raza's biggest supporters is Sen. Harry Reid (D-NV). In 2001, Reid asked the Senate Appropriations Committee for $5 million to help further the racist goals of that organization. That same year, La Raza gave Sen. Reid their Capital Award for "his commitment to advance legislation priorities of the Latino community." Reid in turn praised La Raza by saying: "La Raza is like the biblical David, fighting all these Goliaths." Taxpayer funds are also funneled to La Raza through the Department of Health and Human Services, The Environmental Protection Agency, and even NASA. Tax dollars are hidden in these government agencies, earmarked to be specifically given away to La Raza. Inside the halls of Congress, the practice is known as discretionary funding...In the real world it is known as money laundering! In 2005, $7.9 million was stolen from the American taxpayers and given out to Latino-only charter schools in the form of U.S. Department of Education grants. Most Mexican Immigrants in New Study Gave Up Jobs to Take Their Chances in U.S.

A report about the work lives of recent Mexican immigrants in seven cities across the United States suggests that they typically traded jobs in Mexico for the prospect of work here, despite serious bouts of unemployment, job instability and poor wages.

The report, released Tuesday by the Pew Hispanic Center, was based on surveys of nearly 5,000 Mexicans, most of them here illegally.

Those surveyed were seeking identity documents at Mexican consulates in New York, Atlanta and Raleigh, N.C., where recent arrivals have gravitated toward construction, hotel and restaurant jobs, and in Dallas, Chicago, Los Angeles, and Fresno, Calif., where they have been more likely to work in agriculture and manufacturing.

Unlike the stereotype of jobless Mexicans heading north, most of the immigrants had been employed in Mexico, the report found.

Once in the United States, they soon found that their illegal status was no barrier to being hired here. And though the jobs they landed, typically with help from relatives, were often unstable and their median earnings only $300 a week, that was enough to keep drawing newcomers because wages here far exceeded those in Mexico.

Among respondents to the survey, those who settled in Atlanta and Dallas were the best off, with 56 percent in each city receiving a weekly wage higher than the $300-a-week median. The worst off were in Fresno, where more than half of the survey respondents worked in agriculture and 60 percent reported earning less than $300 a week. The lowest wages were reported by women, people who spoke little or no English, and those without identification.

To some scholars of immigration, the report underlines the lack of incentives for employers to turn to a guest worker program like the one proposed by President Bush because their needs are met cheaply by illegal workers - and all without paperwork or long-term commitment.

Guest workers might instead appeal to corporations like Wal-Mart, the scholars said, where service jobs are now the target of union organizing drives.

"You can't plausibly argue that immigrant-dominated sectors have a labor shortage," said Robert Courtney Smith, a sociologist and author of "Mexican New York: Transnational Lives of New Immigrants." Instead, he said, the report and evidence of falling wages among Mexican immigrants over time point to an oversupply of vulnerable workers competing with each other.

But Brendan Flanagan, a spokesman for the National Restaurant Association, which supports a guest worker program, disagreed. "In many places it is difficult to fill jobs with domestic workers," Mr. Flanagan said. "We've seen a simple lack of applicants, regardless of what wage is offered."

Although the survey, conducted from July 2004 to January 2005, was not random or weighted to represent all Mexican immigrants, it offers a close look at a usually elusive population.

Those surveyed were not questioned directly about their immigration status, but they were asked whether they had any photo identification issued by a government agency in the United States. Slightly more than half over all, and 75 percent in New York, said they did not.

The migration is part of a historic restructuring of the Mexican economy comparable to America's industrial revolution, said Kathleen Newland, director of the Migration Policy Institute, a research organization based in Washington.

The institute released its own report on Tuesday, arguing that border enforcement efforts have failed. Workplace enforcement, which has been neglected, would be a crucial part of making a guest worker program successful.

For now, Mexicans keep arriving illegally.

He gets $518.00 each month for each child born in the USA until that child reaches 18....



He qualifies for Section 8 housing and subsidized rent.



He qualifies for food stamps.



He qualifies for free (no deductible, no co-pay) health care.



His children get free breakfasts and lunches at school...often the mother brings other children not in the school along for the free breakfast...



He requires bilingual teachers and books.



He gets free bus transportation to and from school....we have to pay upwards of $300.00 per year for our children to ride the bus...



He qualifies for relief from high energy bills.



If they are, or become, aged, blind or disabled , they qualify for SSI. If qualified for SSI they can qualify for Medicaid. All of this is at the expense of the American taxpayer.



He doesn't worry about car insurance, life insurance, or homeowners insurance. And in California they do not smog their cars so the air is polluted by over a million more cars



Taxpayers provide Spanish language signs, bulletins and printed material.



He and his family receive the equivalent of $20.00 to $30.00/hour in benefits.



Working Americans are lucky to have $5.00 or $6.00/hour left after paying their bills and his.



Worst of all is this....if this illegal gets amnesty he can bring up to 90 of his relatives into the states to leech even more from the tax payers....if they are elderly they qualify for Social Security benefits without paying a dime into the system...



Cheap labor? YEAH, RIGHT!

Michigan has become the first state in the US to reduce the time during which jobless workers can collect unemployment benefits, cutting the period from 26 to 20 weeks beginning January 2012. The measure is expected to be signed into law by Republican Governor Rick Snyder after passing both the Michigan House and Senate by wide margins as an attachment to a bill maintaining the state’s eligibility for federal extended unemployment benefits.



The 20-week maximum period for receiving state unemployment benefits is the lowest in the country. Michigan, with one of the highest jobless rates in the US, is the first state to set a lower standard than the 26-week minimum recommended by the federal government. Since the 1950s, nearly every state has observed the 26-week standard.



The National Employment Law Project had lobbied in favor of the technical fix required to continue federal unemployment benefits, but called the cut to future state benefits contained in the bill’s final version, “shockingly harsh, reckless and cynical.” Without the change, 37,000 Michigan workers would have lost federal extended unemployment benefits in April and another 150,000 by the end of the year.



The cuts to unemployment insurance are part of a broader attack by the Snyder administration on retirees, schoolchildren, public employees and low-income wage earners. City governments are facing massive reductions in state aid, with a partial restoration tied to imposing cuts on public workers. Meanwhile, retirees face a tax on pensions and low-wage workers will see cuts to the state’s Earned Income Tax Credit. Public education faces large cuts, up to a $700 per pupil reduction in k-12 spending. The spending reductions will be used to help fund a $1.8 billion tax break for business.



Michigan workers already face high levels of joblessness and economic hardship. The state’s official unemployment rate stands at 10.7 percent, well above the national average of 8.9 percent in February. The state is now approaching the 27th month of double-digit unemployment. According to the Labor Department, 44 percent of the jobless in the US have been out of work for more than six months. Nationally, the average time it takes for an unemployed worker to find new employment is nine months. The maximum benefit that an unemployed worker in Michigan can receive is a paltry $362 per week.



More than 171,000 unemployed in Michigan drew over 20 weeks of regular unemployment benefits in 2010, with 130,000 of these drawing 26 weeks. An estimated 275,000 Michigan workers have dropped out of the labor force altogether.



With the federal extended unemployment benefits set to expire at the end of the year and little possibility that the Republican-controlled US House of Representatives will vote for a further extension, there is the real likelihood that unemployed Michigan workers will face cutoff after 20 weeks starting January 2012 when the measure takes effect.



The bill will do nothing to reduce the state’s budget deficit, since unemployment benefits are self-funded through a tax on employers. Once a state exhausts its unemployment funds, it can borrow from the federal government. Currently, Michigan owes more than $3.9 billion to the federal fund. Michigan businesses are expected to save some $1 billion over the next three years in unemployment taxes due to the cuts, most of it winding up in the coffers of the biggest corporations. This at a time when businesses across the United States are sitting on top of a cash pile of around $1 trillion.



The Michigan Chamber of Commerce hailed the bill, cynically calling it a “win-win for job providers hoping to create jobs and individuals struggling to find work.”



The passage of the employment cuts drew little more than pro forma criticism from Michigan Democrats. Opposition was limited to futile appeals to Snyder to veto the measure.



Snyder claimed he had no choice but to sign the unemployment cuts because of strong Republican opposition to permitting an extension of federal benefits unless the state benefit period was shortened.



The precedent set by Michigan may soon be followed by other states. The Florida House has passed legislation reducing the maximum period for receiving unemployment benefits from 26 weeks to as little as 12 weeks if the jobless rate falls below 5 percent. Curren tly, unemployment stands at 11.9 percent in the state. The maximum benefit in Florida is just $275 a week.



Meanwhile, Arkansas is preparing to freeze unemployment benefits while reducing the maximum benefit period from 26 to 25 weeks.



Indiana recently enacted a law that limits eligibility for unemployment benefits and changes the way in which payments are calculated starting in July 2012. It caps the maximum benefit at $390 a week.
